RESOLUTION AUTHORIZING EXECUTIMS, OF SUPPlaMENTAL
ACHNEMTNT WITH fhi, -UNITED STATES 02 AMERICA IN REGARD
TO LEASE OF PORTIONS OF LINCOLN PA,RE, CITY HURSERY,
GOLY COURSE AND ALAMEDA MOLE.
WHEREAS, pursuant to Ordinance NM. 811, New Somies, the City of Alameda,
hereinafter called the Cityg ant-area. into a lease with. the United States of America,
hereinafter called 1 Government, covering lands situated in this city and heisag
portions of Lincoln Park, the City of Alameda, Nursery, the Alameda Municipal Golf
Coarse and the Alameda Mole and a portion of the Club House roof at the Alameda
Municipal Golf Coarse, whiah lease bears date of September 1, 1942, and. is de
nated .0 n. the records of the War Department of the Government Rs Lease No. W. 3460
MUG 3864; and
WHEPEAS, the JO 33 heretofore are 13 11:0 to the City of its inten-
tion to Cancel. said. lease and to terminate same as 33 the 31st day of December,
1944, 11 1310 with. Paragraph 12 of said lease; and
WHEREAS, the Government proposes to negotiate a settlemont in lied of
'113 by the GovetTichant of the 0, required by said lease, whereby
the Covernmont relinqmishes, transfers and ddlivers to the City thp improvements
shown of Scheamde 33' attached to the form of supplemental agreement hereinafter
referred to, and ir addition 13 agrees to pay to the City the sam 11 $450.00 in con-
sideration of the difference between the valme of said improvemonts and the esti-
mated cost of the restoration required by said ledse; and
WHEREAS, a form of saphipmental agreement containing the covenants and
agreements to be stipulated and agreed upon between. the City and. the Government
in connection with the aforesaid lease has beer submitted to this Council at its
regular meeting held March. 6, 1945, and the Council has read said agreement and
is familiar with the contents thereof;
NOW, INERE2H00E, BE IT RESOLVED BY. THE COUNCIL OF 10E CITY OF ALAMEDA
that the City accept the improvomants shmwn. on Schedule "A" at tached. to the form
of supplemental agreembnt heroinabove referred to and ih addition thereto the sum
Of FOUT Hundred. and Fifty Della= (00 50.00) in lieu of restoration of the premises
covered 0; the aforesaid lease; and that M. C. Godfrey, Mayor of the City of Ala-
mhda be, and hp. is hbrely, authorized. to execute, on behalf of the City, a subple-
mental. agreement substantially in the form and containing the termh, covenants,
agreements and. previsions set forth in the aforesaid form of supplamental agreement.
