Resolution 03305RESOLUTION NO. 3305 RESOLUTION OF THE CITY COUNOIL OF THE CITY OF ALAMEDA AUTHORIZING THE FILING OF A DISCLAIMER. WHREAS, the City of Alameda has been served as a defendant in an action to condemn certain lands in said City, which action is now pending in the District Court of the United States in and for the Northern District of California, Southern Division, entitled "United States of America, Plaintiff, vs. Certain Parcels of land in the City of Alameda, County of Alameda, State of California, THE REGENTS OF THE UNIVERSITY OF CALIFORNIA, et al, Defendants," No. 22712-G; and WHEREAS, title to the estate and interest taken in the lens subject of said action vested in the United States of America on the 27th day of July, 1943, and since said day the United States has been in possession of said lands; and WHEREAS, the City of Alameda has no interest in Parcel 1, as described in said action, NOW, THEREFORE, BE IT RESOLVED EY THE COUNCIL OF THE CITY OF ALAMEDA that said City of Alameda has and makes no claim to any compensation which may be awarded for the taking of Parcel 1, as described. in said action; the City Attorney is hereby directed and authorized to file an appropriate Disclaimer in the above entitled action. * * * * * 0 * * * * * The foregoing Resolution was introduced by Councilman Sweeney, who moved its adoption, seconded by Councilman Osborn, and said Resolution was adopted on roll call by the following vote.
