RESOLUTION NO. 5065
CANCELLING CITY TAXES ON FROPETY ACQUIBED BY SCHOOL
DISTRICT FOR PUBLIC PURPOSES. (226C Alameda Avenue)
WHEREAS, the following described real property situated in the City of
Alameda, County of Alameda, State of California, to-wit:
LOT 12 in the east 1/2 of Block "D", as said lot and block
are shown en the "Map of lands adjacent to the To of Encinal,
Alameda County, Cal., surveyed by Jas. T. Stretton, May 1st, 1.567",
flied May 26, 1867, in Book 19 of Maps, page 53, in the office of
the County Recorder of Alameda County, (TAX BILL NO. 4641, 1954-55;
AB 163, Plate 6, Jack Barteni)
has been assessed heretofore for city purposes for the fiscal year 1954-1955 and
taxes levied thereon in the sum of V47.29, of which sum 04.40 has been paid, and
the balance, $12.89, remains uncollected and unpaid; and
WHEREAS, after the time said taxes or assessments became a lien on said
real property, it was, by Deed recorded in the office of the County Recorder of Ala-
meda County on March 23, 1955, in Book 7606, page 553 of Official Records, acquired,
and ever since has been and now is owned by Alameda Unified School District, a public
body, and has been and now is being used for public purposes, and because of such
public ownership is not subject to sale for delinquent taxes; and
WHEREAS, said School District has requested the cancellation of said uncol-
lected taxes;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA, with
the written consent of the City Attorney attached hereto, that all uncollected taxes
charged or levied for city purposes upon the aforesaid reel property, together with
penalties and costs thereon, be, and the same are hereby cancelled, and the Auditor
and the Tax Collector of the City of Alameda are hereby authorized and directed to
cancel the same on their respective books.
NE IT FURTHER RESOLVED, anything in this resolution to the contrary not
withstanding, that this resolution and order shall not be construed as cancelling,
or authorizing the cancellatipn of, any special assessment taxes levied against said
real property by the City of Alameda pursuant to the provisions of the ”Acquisition
and Improvement Act of 1925.
I, J. P. CLARK, City Attorney of the City of Alameda, State of California,
do hereby consent to the cancellation of any and all uncollected taxes and assess-
ments or penalties and costs thereon, charged or levied for city purposes upon the
real property described in the within resolution.
