Resolution 05898445 RESOLUTION NO, 5898 RESOLUTION OF INTENTION TO ORDER THE VACATION OF SAN ANTONIO AVENUE BETUFEN LAFAYETTE AND CHESTNUT STREETS, IN THE CITY OF ALAMEDA. RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the public interest requires, and said. Council hereby declares its intention to order the vacation, clos- ing and abandonment of that certain portion of San Antonio Avenue between Lafayette and Chestnut Streets, in the City of Alameda, County of Alameda, State of California, und more particularly described Ek3 follows; EEING all of San Antonio Avenue, 60 feet in width, between the easterly property line of Lafayette Street and the westerly property line of Chestnut Street, as shown on the "Map of the Bartlett Tract, Alameda, February 1878", as filed in the office of the Alameda County Recorder in February, 1878. RESOLVED, FUBTHER, that said Council finds and determines that the public convenience and necessity- require the reservation to the City of Alameda of a per manent easement and right-of-way over and across and under a certain parcel of land situate in that portion of San Antonio Avenue proposed to he vacated, for the purpose of constructing, operating, maintaining, replacing, renewing and repairing thereon all public utilities including, but not limited to, storm and sanitary sewers, facili- ties for transmission of water, gas, electricity and telephonic and telegraphic mess- ages, or either of them, and said permanent easement and right-of-way for the afore- said purposes is hereby reserved to the City of Alameda and excepted from the vacation of said portion of San Antonio Avenue, over, acmes and under that certain parcel of land situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: BEGINNING at the intersection of the southerly line of San Antonio Avenue with the easterly line of Lafayette Street, as said streets are shown on the "Map of the Eartlett Tract, Alameda, Febru- ary 1678", as filed February 1878 in the office of the Alameda County Recorder, Alameda County, California; thence easterly along the southerly line of San Antonio Avenue 216.00 feet to the west property line of Chestnut Street as shown on said map; thence northerly along an exten- sion of the west property line of Chestnut Street 45.00 feet; thence westerly along a line parallel to and 45.00 feat from the southerly line of San Antonio Avenue 216.00 feet to an extension of the east property line of Lafayette Street; thence southerly along said extension of Lafayette Street 45.00 feet to the POINT OF BEGINNING. REOOLNED, FURTHER, that the portion of San Antonio Avenue to be vacated and abandoned and the details of said vacation are more particularly shown upon that cer- tain. map known as Drawing 4785, Case 52, bearing the legend: "Closing of San Antonio Avenue Between Lafayette and Chestnut Streets", which map is hereby approved for the purpose of this proceeding and is nereby ordered filed in the office of the City Clerk of the City of Alameda, and which map is hereby referred to for particulars as to the proposed vacation. RESOLVED, FURTHER, that the 3rd day of MARCH, 19,2), at 7:30 o'clock p.m. of said day, in the COUNCIL CHAMBERS in the CITY HALL, at the northwest corner of Santa Clara Avenue and Oak Street, Alameda, California, be, and the same is hereby, fixed as the time and place for hearing by the Council of said City of all persons interested in or objecting to the proposed vacation. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to cause this resolution to be published, in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general .circulation published and circulated in said City, and the official newspaper thereof. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to post, or cause to be posted, conspicuously along the line of the street and parts of street proposed to be vacated, notices of such vacation, in the form and manner required by the legislative act hereinafter mentioned. RESOLVED, FURTHER, that in the herein proposed vacation of said strnet or portion of street aforementioned, the Council of the City of Alameda hereby elects to proceed under and in pursuance of the provisions of the Street Vacation Act of 1901 of the State of California (Chapter 250, Statutes of 1941), as amended. 4 4 6 I, the unjersigned, hereby certify that the foregoing Resolution was duly and reguierly introduced and adopted by the Council of the City of Alameda in regu- lar meeting assembled on the 3rd day of February, 1959, by the fellowing gote, to wit: AYES': Councilmen Collischonn, Freeman, Petersen, Schacht and President McCall, (5).
