Resolution 05972RESOLUTION NO. 5972 RESOLUTION OF INTENTION TO ORDER THE VACATION OF RALEIGH PLACE, IN THE CITY OF ALAMEDA (HETWEEN FRANCISCAN WAY AND WEITERALI, PLAC E—S99}4 SHORE). RESOLVED BY T-HE COUNCIL OF THE CITY OF ALAMEDA that the public interest requires, and said Council. hereby declares its intention to order the vacation, clos- ing and abandonment of Raleigh. Place, in the City of Alameda, County. of Alameda, State of California, and more particularly described es follows: ALL of Raleigh Place, 24.00 feet wide, es said Place is shown on the map of "Tract 1947" filed November 26, 1956 at pages 34 and 35, in Liook 39 of Maps, in tae Alameda County Recorder's Office. RESOLVED, FURTHER, that said Council finds and determines that the public convenience and necessity require the reservation to the City of Alameda of a perman- ent easement and right-of-way over, across and under all of Raleigh Place, proposed to be vacated, for the purpose of constructing, operating, maintaining, replacing, renewing and repairing thereon all public utilities including, but not limited to, facilities for transmission of water, gas, electricity and telephonic and telegraphic messages, or either of them, but not including storm or sanitary sewers, and said permanent easement and right-of-way for the aforesaid purposes is hereby reserved to the City of Alameda and excepted from the vacation of Raleigh Place, over, across and under that certain parcel of land situate in the City of Alameda, County of Ala- meda, State of California, and more particularly described es follows: ALL of Raleigh Place, 24.00 feet wide, as said Place is shown on the map of "Tract 1947" filed November 26, 1959 at pares 39 and 350 in Book 39 of Maps, in the Alameda County Recorder's Office. RESOLVED, FURTHER, that all of Raleigh Place to be vacated and abandoned and the details of said. vacation are more particularly shown upon that certain map known as Drawing 4828, Case 52, bearing the legend: "Abandonment of Raleigh Place-- Franciscan Way to Whitehall Place", which map is hereby approved for the purpose of this proceeding and is hereby ordered filed in the office of the City Clerk of the City of Alameda, and whichuap is hereby referred to for particulars as to the pro- posed vacation. RESOLVED, FU- HER, that the 16th day of AUGUST, 1959, at 730 o'clock p.m. of said day, in the COUNCIL CHAMBERS in the CITY HALL, at the northwest corner of Santa Clara Avenue and Oak Street, Alameda, California, be, and the same i3 hereby, fixed as the time and place for hearing by the Council of said City of all persons interested in or objecting to the proposed vacation. RESOLVED, EIJTHER, that the City Clerk of the City of Alameda is hereby directed to cause this resolution to be published, in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said City, and the official newspaper thereof. RESOLVED, FURTHER, that the City Clerk of tha City of Alameda is hereby directed to post, or cause to be posted, conspicuously along the line of the street and parts of street proposed to be vacated, notices of such vacation, in the form and manner required by the legislative act hereinafter mentioned. RESOLVED, FURTHER, that in the herein proposed vacation of said street or portion of street aforementioned, the Council of the City of Alameda hereby elects to proceed under and in pursuance of the provisions of the Street Vacation Act of 19!41 of the State cf California (Chapter 250, Statutes of 1941), as amended. 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regu- lar mooting assembled on the 21st day of July, 1959, by the following vote, to wit: AYES: Councilmen Cellischonn, Freeman, Petersen and President McCall, (4).
