RESOLUTION YO. 5974
AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY
FOR PUBLIC STREF.17 AND HIGHWAY PURTOSES--TILDEN WAY
(2701-2703 FERNSIDE BOULEVARD).
WHEREAS, public interest and necessity require that the real property herein-
after described be acquired by the City of Alameda for use by said City for public
street and highway purposes; and
WHEREAS, Peter Frank Faye and Esther P. Faye, his wife, are the owners of
the real property situated in the City of Alameda, County of Alameda, State of Cali-
fornia, hereinafter described, and are willing to sell the same to the City of Alameda
for the sum of $700.00:
NOW THEREFORE, BE IT RESOLVED hY THE COUNCIL OF THE CITY OF ALAS that the
City of Alameda purchase from Peter Frank Faye and Esther F. Faye, his wife, for the
sum of 8700.00, that certain real property situated in the City of Alameda, County of
Alameda, State of California, more particularly described RS follows;
COMMENCINI3 at the intersection of the southeasterly line of Pearl Street and
the northeasterly line of Fernside Boulevard as said linos, street and
boulevard are described in deed to the City of Alameda, recorded Febru-
ary 27, 1952 in Rook 6665 of Official Records, at page 523, in the Alameda
County Recorder's Office, and as also shown on Drawing 3939, Case 51,
Sheet 5 and Sheet 9, City Engineer's Files, City of Alameda, California;
said intersection has tha coordinates of y - 1:66,154.119 feet and x
1,499,446.29 feet bused on the California Coordinate System, Zone III,
as are all bearings, distances and coordinates in this description;
THENCE along said southeasterly no of Pearl Street North 3.4* 27, 25" East
85.15 feet to the point of intersection with the southerly line of
Tilden Way, 70 feet in width, es said way is also shown on the aforesaid
drawing; said point has the coordinates of y - L66,224.71 feet and x
1,499,!]94.47 feet and is the TRUE „POINT Q BEGINNINC;
THENCE continuing along said southeasterly lino of Pearl Street North 34*
27' ?5" East 16.85 feet to the intersection with the northeasterly line
of that parcel of land described in deed to Clarence C. Powell and Sarah E.
Powell, his wife, recorded January )a., 1950 in Book 5960 of Official
Records, et page 118, in the Alameda County Recorder's office;
THENCE along the last said line South 69* 56' 57" East P2.52 feet to its
intersection with the aforesaid southerly line of Tilden Way;
THENCE along said southerly line of Tilden Way South 75* 29' 26" lest 33,00
feet to the TRUE POINT OE 7‘•,:EOP0 PINC,
on the following terms and conditions:
(a) That good and merchantable title in fee simple in said real property
be conveyed to the City of Alameda, free and clear of all objections, liens and encum-
brances.
(b) That the title to said real property be evidenced by a policy of title
insurance, issued by boo California Pacific Title Insurance Company, insuring title
in the City of Alameda, as provided in the ?receding subdivision, said title insurance
to 'ne at the expense of the City.
(e) That upon deposit with said title company, for delivery to the City of
Alameda, of R Food and sufficient deed of grant conveying said real property to the
City of Alameda, and conditioned upon the issuance of a title insurance policy, as
aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for
700.00, payable tc the order of and delivered to said California ,'ncific Title Insur-
ance Company, as escrow holder, for tee purpose of effecting the cons*mmeition of 3did
purchase.
FESOIVED, FURTHER, that the sum of 3750.00 is hereby appropriated from the
Special Gas Tax Street improvement Fund (Account 222) to pay tne purchase prise of
said real property, cost of title insurance policy, and other expenses.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adeptad by the Council of the City of Alameda Jr regu-
lar meeting as>ambled on the 21st day of July, 1959, by the ainr vote, to wit:
AYES: Councilmen Collischonn, Preeman, Petersen and
President McCall, (4).
NOES: None.
ABSENT: Councilman Schacht, (1).
