ORDERING THE VACATION OF RALEIGH PLACE, BETWEEN
FRANCISCAN 'TAY AND WHITEHALL :PLACE, IN TEE CITY
OF ALAMEDA
WHEREAS, the Cteincil of the City of klaMede did, en the 21st day of July,
1959, pass its Resolution of Intention No. 5972, declaring its intention to order the
vacation, closing and abandenmert of Raleigh Placa, between Franciscan Way and White-
hall Place, in the City of Ala-eda, County of Alameda, State of California, more par-
ticularly described in said Resolution of Intention as follows:
ALL of Raleigh Place, 24.00 feat wide, as said Place is shown
on the map of "Tract 1947" filed November 26, 1958 at pages 3i and
35, in Book 39 of Maps, in the Alameda County RecorderTs Office.
and
WHEREAS, by said Resolution of Intsntion said Council declared and deter-
mined that public convenience and necessity require the reservation to the City of
Alameda of a permanent easement and right-of-way over, across and under all of Raleigh
Place, proposed to be vacated, for the purpose of constructing, operating, maintain-
ing, replacing, renewing and repairing thereon all public utilities including, but
not limited to, facilities for transmission of water, gas, electricity and telephonic
and telegraonic messages, or either of them, but net including storm or sanitary
sewers, and did by said Resolution of Intention reserve to the City of Alameda, for
the aforesaid purposes, a permanent easernt and right-of-way over, across and under
that certain parcel of land hereinafter described;. and
WHEREAS, all of said street to be vacated and abandoned and. the details of
said vacation, together with easements to be retained, are more particularly shown
upon that certain map known as Drawing 4828, Case 52, bearing the legend: "Abandon-
ment of Raleigh Place--Franciscan Way to Whitehall Place", which map was by said
Resolution of Intention approved for the purpose of this proceeding and was ordered
filed in the office cf the City Clerk of the City of Alameda and marked "Piled July
21, 1959", and which map wan in said. resolution referred to for further particulars
as to the proposed vacation; and
WHEREAS', the City Clerk of the City of Alameda caused said Resolution of
Intention to he published in the manner prescribed by law for the publishing of ord-
inances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of gener-
al circulation published and circulated in said city and thh official nnwspaper
thereof; and
WHEREAS, proof of said publication is evidenced by an affidavit of publi-
cation. now on file In inc office of the City. Clerk of said eity;. and
WHEREAS, proof of said posting of such notice is evidenced by tha affidavit
of the person posting Said notices, which affida-vit sets forth the facts regarding
such posting and is now on file in the office of the City Clerk of said City; and
WHEREAS:, the matter cf said proposed vacation came on regularly for hearing
before the Council cf tne City- of Alameda at its regular meeting on the 18th day of
August, 1959, and at the time and place fixed in said Resolution of Intention, and
at such hearing tne said Council heard the evidence offered by Rll persons interested
in said street vacation, and a full hearing thareop having boon had and the matter
submitted for determination.;
NOW THEREFORE, BE IT RESOLVED 'Y THE COUNCIL eF THE CITY OF ALAMEDA that
said Council hereby finds and determines, from all the evidence submitted, that the
street and part thereof in said Resolution of Intention and hereinbsfore more par-
ticularly described is unnecessary for present and prospective public street purposes
and that public interest requires the vacation of said straat,
'BE 1 FUETHER RESOLED that all of Raleigh Placa, in said Resolution of
intention and hercinabove more particularly described, he, and ti o name is hereby,
vacated and abandoned.
RESOLVED, F= HER, that public convenience and necessity require the
reservation of, and there is hereby reserved. to the City of Alameda, a permanent
easement and right-of-way OVE,,i, across and under ail of Raleigh. Plapa, for the pur-
pose of constructing, operating, maintaining, replacing, renewing and repairing
thereon all public utilities including, but not limited to, facilities for trans-
mission of water, gas, electricity and telephonic and telegraphic massages, or either
of then, tbt not Including storm or sanitary sewers; said Raleigh, Place being that
certain parcel of land situate in the City. of Alameda, County of Alameda, State pf
California, and more particularly. described as follows7;
ALL of Raleigh 'Place, 24.00 feet wide, as said Place is shown
Gn the map of "Tract 1947" filod November 2E, 1958 at pages 34 and
35, in Book 35 of Maps, in the Alameda County Recorder's Office;
and said parcel i3 hereby excetted from tha vacation of said Raleigh Place for tho
above purposes.

and regularly introduced and adopted by the Council uf the City of Alameda in regu-
lar meeting assembled on the 16th day of August, 1959, by the following. vote, to wit:

ABSENT:. Councilman Freeman, (1).
