CANCELLING CITY TAXES ON PROPERTY ACQUIRED BY THE
CITY OF ALAMEDA FOR MUNICIPAL PURPOSES (TILDE WAY).
WHEREAS, the following described real property, situated in the City cf
Alameda, County of Alameda, State of California, to it
Tx 3i11 No. 3796, 1959-1960; Assessor's Block 130,
'Plate 37; Percy D. and Reiss Fleminp7;
Lot 1 in Jenks & Mead Homestead,
:IRS been assessed heretofore for City purposes for the fiscal year 1959-1960, and
taxes levied thereon in the sum of $71.9a are uncollected and unpaid; and
WHEREAS, after the time said assessment and taxes became a lien on said
real property, it was, by Order Fixing Amount of Security for Immediate Possession
of Lands Sought to be Condemned, dated March 17, 1959, action No. 296953 in the Su:oer-
ior Court of the State of California, in and for the County of Alameda, entitled
"City of Alameda, Plaintiff, 1,3. Percy D. Fleming, Fess FleminF, et al, Defendants,"
acquired, and ever since has been, and now is, owned by the City of Alameda, and has
been and now is being used for public purposes, and because of such public ownership
is not subject, to sale for delinquent taxes;
NOW THEREFORE, BE IT RESOLVED EY THE CCUNCIL OF THE CITY OF ALAMEDA, with
the written consent of the City Attorney attached hereto, that all uncollected taxes
charged or levied for City purposes upon the aforesaid real property, together with
penalties and costs thereon, be, and the same are hereby, cancelled, and. the Auditor
and the Tax Collector of the City of Alameda are hereby authorized and directed to
cancel the same on their reopective books.
T, Frank Annibalo, City Attorney of the City of Alameda, State of California,
do hereby consent to the cancellation of any and ell uncollected taxes and assessments
and penalties and costs thereon, charged or levied for City rrnoeas pon the parcels
of real property described in the within Resolution.
