Resolution 06060RESOLUTION NO, 6060 AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC STREET AND HIGHWAY PURPOSES—TILDEN WAY (CONRAD ROTH). WHEREAS, public interest and necessity require that the real property here- inafter described be acquired by the City of Alameda for use by said City for public street and highway purposes; and WHEREAS, Conrad Roth is the owner of the real property situated in the City of Alameda, County of Alameda, State of California, hereinafter described, and is willing to sell the same to the City of Alameda for the sum of $50.00; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the City of Alameda purchase from Conrad Roth, for the sum of $50.00, that certain real property situated in the City of Alameda, County of Alameda, State of California, more particularly described es follows; PORTION of the parcel of land described in the deed to Conrad Roth, dated January 20, 1949, recorded February 10, 1949 in Book 5724 of Official Records of Alameda County, page 132, (AD-9671), described as follows: BEGINNING at the intersection of the southwestern line of the parcel of land above referred to, with the northern line of the right of way, 50 feet wide, formerly of the San Francisco and Alameda Railroad, now the Central Pacific Railway Company; running thence along the last named line easterly 16.98 feet to the southeastern line of the parcel of land above referred to; thence along the last named line north 3L* P2' 42" east 2.4U feet to a point from which the center of a circle with a radius of 619.13 feet bears north 4* 26' 57" west; thence along the arc of said circle westerly 20.32 feet to the said southwestern line of the parcel of land above referred to; and thence along the last named line south 55* 19' 29" east 1.65 feet to the point of beginning. The bearings and distances used in the above description are based on the California Coordinate System, Zone 3; on the following terms and conditions: (a) Teat good and merchantable title in fee simple in said real property be conveyed to the City of Alameda, free and clear of all objections, liens and encum- brances. (b) That the title to said reel property be evidenced by a policy of title insurance, issued by the California Pacific Title insurance Company, insuring title in the City of Alameda, as provided in the preceding subdivision, said title insurance to he at the expense of the City. (c) That upon deposit with said title company, for delivery to the City of Alameda, of a good and sufficient deed of grant conveying said real prcperty to the City of Alameda, and conditioned upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City be drawn for $50.00, payable to the crder of and delivered to said California Pacific Title Insur- ance Company, as escrow holder, for the purpose of effecting the consummation of said purchase. RESOLVED, FURTHER, that the sum of 150.00, together with a sum sufficient to cover cost of title insurance and other incidental expenses to said transaction is hereby appropriated from the Special Gas Tex Street Improvement Fund (Account 222) to pay the purchase price of s aid real property, cost of said title insurance policy, and incidental expensee. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regu- lar meeting assembled on the 5th day of April, 1960, by the following vote, to wit: AYES: Councilmen Collischonn, Freeman, Petersen, Schacht and President McCall, (5).
