AUTHORIZING THE ACQUISITION OF CERTAIN REAL, PROPERTY FOR PUBLIC
STREET Al) 'HIGHWAY PURPOSES -- NORTIMEST CORNER OF PARK STREET
AND BUENA VISTA AVENUE (SWSS)
WHEREAS, public interest and necessity require that the real properey hereinafter described
he acquired by the City of Alameda for use by said City for public street and highway purposes; and
WHEREAS, Walter J. Simas and Jean Lenore Simas, his wife, (as joint tenants) are the owners
of the real property situated in the City of Alameda, County of Alameda , State of California, here-
inafter described, and are willing to sell the same to the City of Alameda fcr the sum of $425.00;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the City of Alameda
purchase from Walter J. Simas and Jean Lenore Simas, his wife, for the sum of $425.00, that certain
real property situated in the City of Alameda, County of Alameda, State of California, more particu-
larly described as follows
A PARCEL of land situate in the City of Alameda, County of Alameda, State
of California, and being a portion of that land described in deed to Robert C. Beck
dated March 16, 1946 and recorded in Book 4869 of Official Records of Alameda
County, at page 315, and further described as follows:
BEGINNING at the point of intersection of the northerly line of Buena
Vista Avenue, 70.00 feet in width, with the westerly line of Park Street, 80.00
feet in width; the aforesaid point has the coordinates of y 466,466.68 feet and
x - 1,497,505.57 feet based on the California Coordinate System, Zone III, as are
all bearings, distances and coordinates in this description; thence along the
aforesaid northerly line of Buena Vista Avenue north 600 04' 08" west 28.04 feet
to an intersection with the arc of a 180.63 foot radius curve the bearing to center
of curve being north 16° 25, 21" east; thence southeasterly along the arc of said
180.63 foot radius curve 13.22 feet to a point uf compound curvature with a 39.00
foot radius curve, the bearing to centers of curves being north 12° 13, 47" east;
thence along the arc of the 39,00 foot radius curve 19.68 feet to an intersection
with the aforesaid westerly line of Park Street where the bearing to center of
curve is north 160 40' 47" west; and thence along said westerly line of Park Street
south 340 46° 13" west 13.96 feet to the point of beginning.
CONTAINING 141,2 square feet, more or less;
on the following terms and conditions;
(a) That good and merchantable title In fee simple in said real property be conveyed to the
City of Alameda, free and clear of all objections, liens and encumbrances.
(8) That the title to said real property be evidenced by a pnlicy of title insurance issued
by the California Pacific Title Insurance Company, insuring title in the City of Alameda, as provided
in the preceding subdivision, said title insnirance to he at the expense of the City.
(c) That upon deposit with said ticle company, for delivery to the City of Alameda, of a
good and sufficient deed of grant conveying said real property to the City of Alameda, and conditioned
upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a
warrant of the City he drawn for $425, payable to the order of and delivered to said California Pacific
Title Insurance Company, as escrow holder, for the purpose of effecting the consummation of said
purchase.
RESOLVED, FURTHER, that the sum of $475.00 is hereby appropriated from the Special Gas Tax
Street improvement Fund (Account 222) to pay the purchase price of said real property, cost of title
Insurance policy, and other expenses.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly intro-
duced and adopted by the Council of the City of Alameda in regular meeting assembled an the 7th day of
February, 1961, by the following vote, to wit:
AYES: Council-en Collischonn, Freeman, Petersen, Schacht and President mccall, (5).
