AND HIGHWAY PURPOSES—TILDE" Oa" (RUSSOR-PEDEMONTE),
WHEREAS, public interest and necessity require that the re, l. proper ty. bemeinafter described
be acquired by the City of Alameda for use by said City for public street and. highway purposes; and
ALPSAFAS, Franb. Masse and Edith Musso, his wife, (Las joint tenants) and Aurelea 1<., 31<,.
are the owners of the real property situated in the City of Alameda, County of Alameda, State of
California, hereinafter described, and are willing to sell the some to the Ci(y of Alameda for the
sum of $250.00;
NCM THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CIP7 OF ALAMEDA ghat the City of Alameda
purchase from Frank 'Russo and Edith Mosso, his wife, and ammolia Pedermnte, for the sum of $250.00,
that certain. reml property situated in the City of Alameda, County of Alameda, State of California,
more particularly demcribed as. follows:
COMMENCING at thm. inters< ction. of the northwestmrly line of Pearl Street,
60.00 feet wide, with the northeasterly line. of Eagle Avenue, 60.00 feet wide,
as said street and avenue now exist; running thence along said northwesterly
line north 347 27' 25" east 299.70 feet (based on the California Coordinate
System, Sone III, as are all bearings ar d. distances in this deser.iptiong;
thence north 55f 38' 17" west 169.32 feet co the most westerly corner of the
parcel of land described in deed from Southern Pacific Company, a corporation,
tn Sidney Traver, recorded August 27, 1941, at page 150, in Book 4115 of
Official. Records of Alameda County, 1, r<' 00-469(38); thence along the north-
mesterly line of said parcel north 75' 03' 05" east. 73.28 feht to the true
point of beginning; running thence continuing along said line north 75. 03' 05"
east 37.50 feet to the southwesterly line of the parcel of 1mnd described in the
deed from Clinton L. and Frances Hawey to the City of Alameda, dated Crtobex 21,
1960, and recorded October 28, 1960, on Reel 196, Image 6', Series A3' -127999,
Official Records of Alameda County; thence along said southwesterly line south
55' 38' 17" east 9.45 feet; thence south 84° 22' 15" west 64-75 feet to the true
point of beginning,
on the following terms and conditions:
(a) That good and merchantable title in fee simple in said real proporty be conveyed to the
City of Alameda, free and clear of all objections, liens and encumbrances.
(b) That the title Flo said real propexty be evidenced by a policy of title insurance, issued
by the CalLfornia Pacific Title Insurance Company, insuring title in the City of Alameda, as provided
in the preceding subdigision, said title insurance to be at the expense of the City.
(c) That upon deposit with said tiffe company, for delivery to the City of Alameda, of a
good and sufficient deed of grant conveying said real property to the City of Alameda, and conditioned
upon the issuance of a title insurance policy, as aforesaid, to be approved by the City Attorney, a
warrant of the City be drawn for $250.00, payable to the order of and delivered to said California
Pacific Titia Inauranne Company, as escrow holder, for the purpose of effecting the consummation of
said purchase.
RES0177Mi3 , FURTHER, that tbe sum of 5250.00, together with a sum sufficient to cover cost of
title insurance and other incidental expenses to said transaction is hereby appropriated from the
Special Gas Tax 31<31 Improvement Fund, No. 222, tAD pay the murhage price of said real property,
cost of said title insurance policy, and incidental expenses.
I, the undersigned, hereby certify that the foregoing Resolution gag duly and regalamly
introduced and adopted. by the Council of the City of Alameda in regular meeting assembled on the 21st.
day of March, 1951, by the following vote, to wit:
AYES: Councilmn Collgschonn, Freeman, Petersen, Schacht and Presidenm McCall, (5).
NOES: None.
ABSENT: None.
