Resolution 06299CITY OF ALAMEDA RESOLUTION NO. 6299 RESOLUTION OF THE COUNCIL OF THE CITY OF ALAMEDA ORDERING THE VACATION OF A PORTION OF POWELL STREET, IN THE CITY OF ALAMEDA (BETWEEN OAK STREET AND PARK STREET). WHEREAS, the Council of the City of Alameda did, on the 7th day of November, 1961, pass its Resolution of Intention No. 6288, declaring its intention to order the vacation, closing and abandonment of that certain portion of Powell Street, between Oak Street and Park Street, in the City of Alameda, County of Alameda, State of California, more particularly described in said Reso- lution of Intention as follows: PARCEL 1: BEGINNING at a point on the easterly line of Oak Street distant southerly thereon 925 feet from the southerly line of Clinton Avenue, said point being the northerly corner of the parcel of land described in the deed from Powell Brothers Construc- tion Company to the City of Alameda recorded February 21, 1919 at page 49, Book 2743 of Deeds, Alameda County Recorder's office; THENCE along the northeasterly line of said parcel South 39. 59' 44" East 76.17 feet to the easterly line of the parcel of land described in the Quitclaim Deed from Robert W. Carlson to Ruth M. Carlson recorded October 2, 1957 at page 271, Book 8483, Official Records of Alameda County; THENCE along the direct extension southerly of the easterly line of last said parcel, South 29° 19' West 11.81 feet; THENCE South 50° 00' 16" west 20.33 feet to the southwesterly line of said parcel from Powell Brothers Construction Company to the City of Alameda; THENCE along said southwesterly line North 39° 59 44" West 68.00 feet to the direct extension southerly of said easterly line of Oak Street; THENCE along last said extension, northerly, 33.72 feet to the BEGINNING. PARCEL 2: BEGINNING at the westerly corner of the parcel of land described in the Quitclaim Deed from Willis A. Guthrie to Willis A. Guthrie and Trudie Guthrie recorded March 7, 1960 on Reel 40, Image 602, Official Records of Alameda County, said corner being a point on the northeasterly line of Powell Street as said street is described in the deed from Powell Brothers Construction Company to the City of Alameda recorded February 21, 1919 et page 49, Book 2743 of Deeds, Alameda County Recorder's office; THENCE along said northeasterly line of Powell Street South 39° 59' 44" East 62.92 feet to the westerly line of Park Street; THENCE along the direct extension southerly of said westerly line of Park Street, southerly 32.73 feet to the southwesterly line of last said parcel; THENCE along said southwesterly tine North 39' 59' 44" West 68.05 feet; THENCE North 50° 00' 16" East 20.33 feet to the direct extension southerly of the westerly line ef said parcel from Willis A. Guthrie; THENCE along last said extension North 29° 19' East 11.81 feet to the BEGINNING; and WHEREAS, the portion of said Powell Street to be vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known as Drawing 5084, Case 51, bear- ing the legend "Closing Powell Street between Oak Street and Park Street", which map was by said Resolution of intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed Nov. 7, 1961", and which map was in said resolution referred to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be published in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said city and the official newspaper thereof; and WHEREAS, proof of said publication is evidenced by an affidavit of publication now on file in the office of the City Clerk of said city; and WHEREAS, proof of said posting of such notice is evidenced by the affidavit of the person posting said notices, which affidavit sets forth the facts regarding such posting and is now on file in the office of the City Clerk of said City; and WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council of the City of Alameda at its regular meeting on the 5th day of December, 1961, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persons interested in said street vacation, and a full hearing thereon having been had and the matter submitted for determination; NOW THEREFORE, BE IT RESOLVED BY DIE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street and part thereof in said Resolution of Intention and hereinbefore more particularly described is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said por- tion of said street. BE IT FURTHER RESOLVED that the portion of said Powell Street in said Resolution of Inten- tion and hereinbefcre more particularly described be, and the same is hereby vacated and abandoned. * * * * * * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 5th day of December, 1961, by the following vote, to wit!
