CITY OF ALAMEDA RESOLUTION NO. 6425
ORDERING THE VACATION OF A CERTAIN PORTION OF MARKET STREET,
IN THE CITY OF ALAMEDA (SAN JOSEAVENItE TO MADISON STREET).
WHEREAS, the Council of the City of Alameda did, on the 20th day of November, 1962, pass
its Resolution of Intention No. 6519, declaring its intention to order the vacation, closing and
abandonment of that certain portion of Market Street, between San Jose Avenue and Madison Street,
in the City of Alameda, County of Alameda, State of California, more particularly described in said
Resolution of Intention as follows:
BEGINNING at the intersection of the northwesterly line of Market Street, 60 feet wide, with
the southwesterly tine of Madison Street, 60 feet wide, as said lines and streets are
shown on the "Map of Town of Alameda and Adjacent Lands" as surveyed by H. A. Higley
and filed September 12, 1867 in Book 5 of Maps, at page 16, in the Alameda County
Recorder's office;
THENCE southeasterly along the direct Extension of said southwesterly line of Madison Street
60 feet to the southeasterly line of said Market Street;
THENCE southwesterly along lest said line 200 feet to the northeasterly line of San Jose
Avenue (formerly Jefferson Street), 60 feet wide, as last said street is shown on
aforesaid Map;
THENCE northwesterly along the direct extension of said northeasterly line of San Jose
Avenue 60 feet to the aforesaid northwesterly line of Market Street;
THENCE northeasterly along lent said line 200 feel to the BEGINNING;
and
WHEREAS, by said Resolution of Ineention said Council declared and determined that public
convenience and necessity require the reservation to the City of Alameda of permanent easements and
rights-of-way over and across and under certain parcels of land situate in that portion of Market
Street proposed to be vacated, for the purpose of constructing, operating, maintaining, replacing,
renewing and repairing thereon all public utilities including, but not limited to, storm and sani-
tary sewers, facilities for transmission of water, gas, elecericity, or either of them, and did
by said Resolution of Intention reserve to the City of Alameda, for the aforesaid purposes, per-
manent easements and rights-of-way over and across and under Chose certain parcels of land herein-
after described; and
WHEREAS, the pnrtion of said street to he vacated and abandoned and the details of said
vacation, together with easements to be retained, are more particularly shown upon that certain map
known as Drawing 5220, Case 54, bearing the legend: "Portion of Market Street to be Abandoned --
San Jose Avenue to Madison Street", which map was by said Resolution of Intention approved for the
purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of
Alameda and marked "Filed Nov. 20, 1962", and which map was in said resolution referred to for
further particulars as to the proposed vacation; and
WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention eo be
published in the manner prescribed by law for the publishing of ordinances of the City of Alameda,
in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in
said city and the official newspaper thereof; and
WHEREAS, proof of said publication is evidence by an affidavit of publication now on file
in the office of the City Clerk of said City; and
WHEREAS, proof of said posting of such notice is evidence by the affidavit of the person
posting said notices, which affidavit sets forth the facts regarding such posting and is ROW on
file in the office of the City Clerk of said City; and
WHEREAS, the matter of said proposed vacation came on regularly for hearing before the
Council of the City of Alameda at its regular meeting on the 18th day of December, 1962, and at the
time and place fixed in said Resolution of Intention, and at such hearing the said Council heard
he evidence offered by all persons interested in said street vacation, and a full hearing thereon
having been had and the matter submitted for determination;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council
hereby finds and determines, from all the evidence submitted, that the street and part thereof in
said Resolution of Intention and hereinbefore more particularly described is unnecessary for present
and prospective public street purposes and that public interest requires the vacation of said por-
tion of said street.
BE IT FURTHER RESOLVED that the portion of Market Street in said Resolution of Intention
and hereinbefore more particularly described be, and the same is hereby, vacated and abandoned.
RESOLVED, FURTHER, that public convenience and necessity require elle reservation of, and
there, is hereby reserved to the City of Alameda, permanent easements and rights-of-way over and
across and under the following described parcels of land for the purpose of coristruceing, operating,
maintaining, replacing, renewing and repairing thereon all public utilities including, but not
limited to, storm and sanitary sewers, facilities for transmiesion of water, gas, electricity, or
either of them; said parcels of land being sltuate in the City of Alameda, County of Alameda, State
of California, and more particularly described as follows!
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
18th day of December, 1962, by the following vote, to wit:
AYES: Councilmen Godfrey, McCall, Rose, Schacht and President Collischonn, (5).
NOES: None.
ABSENT: None.
