ACKNOWLEDGING EXERCISE OF RIGHT TO RENEW, FOR AN ADDITIONAL
PERIOD OF TWENTY-FIVE (25) YEARS ENDING SEPTEMBER 30, 1989,
CERTAIN LEASE EXECUTED SEPTEMBER I, [946, BETWEEN CITY AND
ASSIGNOR OF TODD SHIPYARDS CORPORATION.
WHEREAS, on September 1, 1946, pursuant tn Ordinance No. 897 N. S., United Engineering
Company (now Matson Navigation Company) leased the following described parcel of land owned by the
City, containing 12.961 acres, more or less, and situate in the City of Alameda, County of Alameda,
State of California:
COMMENCING at Station No. 179 on the Peralta Grant Line, as said station and line are
delineated and so designated on that certain map entitled "Map of Alameda Marsh Land, as
partitioned among the owners thereof in the suit No. 8923, and entitled Pacific Improvement
Company, PlaintiEf, vs. James A. Waymire, et al., Defendants, Superior Court of Alameda
County, State of California," filed July 30, 1900, in the office of the County Recorder of
Alameda County in Map Book 25, pages 74 to 78, and running thence due north 801.06 feet to
a point, said point being the true point of commencement; thence due north 341.2 feet more
or less to a point nn the U. S. Pierhead Lane; thence along said Fierhead Line the follow-
ing courses and distances: North 790 03' 59" East 335.74 feet to a point designated as No.
12 on said line; thence North 730 55' 45" East 1148.51 feet, more or less, to a point on
said Peralta Grant Line; thence along said last named line South 24° 15' West 124.58 feet,
mare or less, to a point thereon known as Station No. 175; thence along said last named
line South 46° 30' West 659.55 feet to Station No. 176 on said line; thence along said line
South 47° 15' West 482.91 feet to Station Ni,. 177 of said Grant Line; thence South 10° 15'
West along said Grant Line a distance of 143.43 feet to a point; thence Westerly on a curve
concave eo the left, having a radius of 1487.42 feet, (the tangent to said curve at last
mentioned point bears North 470 15° 56' West) an arc distance of 616.92 feet to the true
point of commencement, (the tangent to said curve at last mentioned point hears North 71°
01' 46" West)
CONTAINING 12.961 acres, more or less;
and
WHEREAS, the term of said lease commenced on September 1, 1946, and continues to Septem-
ber 30, 1964, with the option of Lessee or its assign, as sea forth in Paragraph 5 thereof, tei
renew for an additional term of twenty-five (25) years, commencing October 1, 1964, and ending
September 30, 1989, for a total rental of Sixty-one Thousand, Five Hundred ($61,500.00) Dollars,
payable in equal monthly installments of Two Hundred Five ($205.00) Dollars per month, in advance,
and upon the condition that Lessee give City at least six (6) months' notice prior rn the expiration
of said original term of its intention to exercise its said option to renew for said additional term;
and
WHEREAS, said Lessee has, with the City's written consent: as evidenced by Resolution Nos-
3705, 3939, 4985, 5293, 5770 and 5909, assigned said lease to Todd Shipyards Corporation, a corpora-
tion duly organized and existing under and by virtue of the laws of the State of New York; and
WHEREAS, said Todd Shipyards Corporation did on February 27, 1964, give notice in writing
ro the City of its intention to exercise its said right of renewal, such intention evidenced by a
certified any of the Minutes of a regular meeting of the Board of Directors nf said corporaefon
held February 24, 1964; and
WHEREAS, this Council acknowledges the terms of said paragraph 5 of said lease and She
right of Lessee or its assigns thereunder to exercise said right of renewal, and desires to recog-
nize formally such exercise;
NOW THEREFORE, 3E IT RESOLVED BY THE COUNCIL OF THE CI Y OF ALAMEDA that the intention of
Tndd Shipyards Corporation, assignee of United Engineering Company (now Matson Navigation Company)
to exercise its right to renew that certain lease from the City of the hereinabove described real
property, said lease executed September 1, 1946 pursuant to Ordinance No. 897 N. S., is hereby
recognized and acknowledged; and
BE IT FURTHER RESOLVED that said lease is hereby renewed for an additional period of tweney-
five (25) years, commencing October 1, 1964, and ending September 30, 1989, for a total rental for
said term of Sixty-one Thousand, Five Hundred (S61,500.00) Dollars, payable in equal monthly install-
ments of Two Hundred Five 0205.00) Dollars per month, in advance.

introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
17th day of March, 1964, hy [11e following vote, to wit:
