Resolution 06610CLTY OF ALAMEDA RESOLUTION NO. 6610 ORDERING VACATION OF TWO PUBLIC SERVICE EASEMENTS (PATHWAY, SEWER, NORTH OF CLEMENT AVENUE IN VICINITY OF WILLOW STREET). BE IT RESOLVED BY IRE COUNCIL OF THE CITY OF ALAMEDA that that certain easement heretofore dedicated for public purposes, being situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: PARCEL NO. 1( All of that right of way described in the Deed of Right of Way between Santa Cruz 01) Corporation and the City of Alameda, recorded May 25, 1938, at page 37, Book 3652, Official Records of Alameda County, bounded and more particularly described as follows: BEGINNING at the most northern corner of Tract 6, as said ITRCI. 6 is shown on the "Map of Alameda Marsh Land" hereinafter referred to, and running thence along the northwesterly boundary line of said Tract 6 and along the center line of Willow Street, as said street is shown on the maps hereinafter referred to, South 28' 39' West 843.35 feet, more or less, to the northern line of Clement Avenue, as said avenue is shown on said maps; thence along said last named line South 61' 21' East 10 feet; thence North 28" 39' East to a point on the northeastern boundary line of said Tract 6; thence along said last named line North 56° 10' West to the point of beginning; BEING a portion of Tract 6 and a portion of Willow Street, as said Tract and street are delineated and Sc, designated upon that certain map entitled, "Map of Alameda Marsh Land as Partitioned among the owners thereof In the suit numbered 8923 and entitled, 'Pacific Improve- ment Company, Plaintiff, vs. James A. Waymire, et a1., Defendants', Superior Court of Alameda Cooney, State of California", filed July 30, 1900, in Liber 25 of Maps, at pages 74 to 78, in the office cf the County Recorder of Alameda County. ALSO BEING a portion of Atlantic Avenue and of Willow Street, as said street and avenue are delineated and so designated upon that certain map entitled, "Resubdivision of Blocks 15, 16 6 17 North of Buena Vista Ave. and East of Willow Street in the City of Alameda, Alameda County, Cal." filed May 26, 1888 in Liber 10 of Maps, at page 22, in the office of the Cooney Recorder of Alameda County, is hereby ordered vacated pursuant to the previsions of Section 50443 of the Government Code of the State of California. BE IT FURTHER RESOLVED that that certain easement heretofore dedicated for public purposes, being Situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows; PARCEL NO. 2: A portion ce that easement and right of way described in the Easement and Right of Way between Santa Cruz Oil Corporation and the City of Alameda, recorded May 25, 1938, at page 38, Book 3652, Official Records of Alameda County, said portion being bounded and more particularly described as follows: COMMENCING at the point of intersection of the northern line of Clement Avenue with the center line of Walnut Street, as said avenue and street are shown on the "Map of Alameda Marsh Lard", hereinafter referred to, and as said Walnut Street is also shown on the "Map of Lands Adjacent to the Town of Encinal", hereinafter referred to running thence North 61° 21' West along said line of Clement Avenue 5 feet; thence leaving said line of Clement Avenue North 28' 39' East 325 feet; thence Westerly parallel with the Northerly line of Clement Avenue 5 feet to the TRUE POINT OF BEGINNING; thence continuing Westerly parallel with the Northerly line of Clement Avenue 925 feet to a point; thence South 28' 39' West 329 feet to a point on the northern line of Clement Avenue; thence North 61' 21' West along said line of Clement Avenue 5 feet, to the center line of Willow Street as said Willow Street is shown on the map of "Resubdivision of Blocks 15, 16 & 17 North of Buena ViSca Avenue and East of Willow Street" hereinafter referred to; thence North 28° 39' East along the center line of Willow Street and along the Northwesterly boundary line of Tract 6, as said Tract is shown on said "Map of Alameda Marsh Land", 335 feet to a point; thence Easterly and parallel with the Northerly line of Clement Avenue 480 feet to a point on the Northwestern boundary line of that certain piece or parcel of land described in the Decree rendered February 18, 1925, in that certain action erritled, "j. H. Baxter 6 Co., a corporation, vs. West Shore Land Company, a corporation, Case No. 79752, in he Superior Court of the State of California, in and for the County of Alameda, a certified copy of which Decree was recorded February 18, 1925, in Tiber 938 of Official Records of Alameda County, at page 146; thence along the last named boundary line South 28' 39' West 5 feet to a point on the Southwestern boundary line of the parcel of land last above referred to; thence along the last named boundary line and along the Northeastern boundary line of Trace 5, as said Tract 5 is shown on said "Map of Alameda Marsh Land" 450 feet to a point; thence South 28e 39 West 5 feet to the TRUE POINT OF BEGINNING; BEING a portion of Tract 5 and of Tract 6, a portion of Atlantic, formerly Blanding, Avenue, a portion of Walnut Street and a portion of Willow Street, as said Tracts, avenue and streets are delineated and so designated upon that certain map entitled, "Map of Alameda Marsh Land as Partitioned among the owners thereof in the suit numbered 8923 and eneteled, 'Pacific improvement Company, Plaintiff, vs. James A. Waymire, et al., Defendants,' Superior Court of Alameda County, State of California", filed July 30, 1900, in Liber 25 of Maps, at pages 74 to 78, in the office of the County Recorder of Alameda County. ALSO BEING a portion of Blocks numbered 15 and 28, and a portion of Walnut Street, as said Blocks and street are delineated and so designated upon that certain Map entitled, "Map of Lands Adjacent to the Town of Encinal, Alameda County, Cal., Surveyed by Jas. T. Stratton May lst, 1867" filed May 28, 1867, in Liber 19 of Maps, at page 53, In the office of the County Recorder of Alameda County. ALSO BEING a portion of Atlantic Avenue and of Willow Street, as said street and avenue are delineated and so designated upon that certain map entitled, "Resubdivision of Blocks 15, 16 and 17 North of Buena Vista Ave, and East of Willow Street in the City of Alameda, Alameda County, Cal.," filed May 26, 1888, in Liber 10 of Maps, at page 22, in the office of the County Recorder of Alameda County, Is hereby ordered vacated pursuant to the provisions of Section 50443 of the Government Code of the State of California. BE IT FURTHER RESOLVED, that the Council of the City of Alameda hereby finds and declares that (1) rhe easements ordered vacated herein are unnecessary for present or prospective public use, and (2) the public service easement hereinabove first described as Parcel No. 1 was for a pathway and was granted to and accepted by the City of Alameda on May 23, 1938, and the public service ease- ment hereinabove second described as Parcel No. 2 was for sewer purposes and was granted to and accepted by the City of Alameda on May 23, 1938; neither said easement described as Parcel No. 1, nor said portion of easement described as Parcel No. 2 hereby vacated, has been used by the City of Alameda for any purpose whatever since the respective date of its said acceptance to the date of this resolution. 0 * * * * * * * 0 * I,the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 5th day of May, 1964, by the following vote, to wit: AYES: Councilmen Freeman, La Croix, Jr., McCall, Rose and President Godfrey, (5).
