37 '13321, BY THE COUNCIL OF THE CITY OF ALAMEDA that it. is the intention. of the Couacil of
the City of Alameda to order the vaeabdon of an unimproved roadway or street, previously ac(1uired.
by the City of Alameda by instrumene recorded May 16, 196-3, RE: 885, Lela 140 (AU 83234), Alameda
County Records, from Buena Vista Apartments, inm., a California corporation, locaeed on the extension
or Fifth Street northerly of Ilicena Vista A,,nor, situated in the City of Alameda, County of Alameda,
State. of California, being more 3771 1777377 described as follows:
BEGINNING at a poinf on the northern line of Buena Vista Avenue, diseant thereon
north 87" 07' 12" west 16.55 feet westerly of the intersection of said northern line
with the center line or Fifth Street extended northerly, said point having coordAnates
of Y-4.70.043.13 feet and X-1,485,239.57 feet based upon the California Coordinate System,
Zone III, as are all bearings and distances in this description; thence north 2' 48' 30"
east 775.82 feet to the line segregating the high land and the marsh land, as said line
is shoum on the Map of Alameda Marsh Land as partitioned among the owners thereof in the
Spit 1.o, 8923, ent1 tled1 "Pacific 1777700577 77 Company, plaintiff, vs. James A. Waymire,
et al„ defendants", Spperier Court, Alameda County, filed July 30, 1900 in. Book 25 of
Maps, pages 74. to 78, inclusive, ih Cne office of the County Recorder of Alameda County;
Odence along the last mentioned line, south 853 25' 08" east 30.02 feet to a. line drawn
parallel with the above mentioned line designated as "north 2' 48' 31' east 775.82
feeta, and distant at right angles 30 feet easterly therefrom; 11 '7, along said
parallel line, south 2' 48' 30" west 774.93 feet to said northern line of Buena Vista

to that certain map enbitled, 'Proposed Vacattion of a Certain '1' 107.1770.1' RoadiEay or Street Located
on the Extension of Fifth. Street. Northerly of Buena Vista Avenue", on file in che office of 11., City
Clerk.
RESOLVED, FURTNER, that 111 Ccunoil of the City .1 Alameda does hereby: find and debermine
that bhe public convenience and nseessity require the reservation. in the City of Alameda, pursuant
to Sections E330 and 8331 of the Streets and Highways Code of 07771 1(77 of the permanent easement.
and 7'' '71 of way at any tTme, or from time to time, to construct, maintain, operate, replace, renew
and remove sanitary sewers, storm drains and sewers, and any and all public utilities, and appurte.n-
aot structures, in., over, under, along and across said street, including the right of convenient.
access, and the right to keep the property free from flammable materials and wood growth, and other-
wise protect the same from all hazards in, upon. and over the street proposed te be vacated.
RESOLVED, FURTHER, thaE these proceedings are taken subject to the reservations hereinabore
set forth.
RESOLVED, FURTHER, that all proceedings for the vacabion herein proposed shall be in accord-
ance the provisions of Part 3 of Envision 9, of the Streetn and Highways Code of California.

vacatdon herein proposed to he posted conspicuously alona the line of said street, • least ren (10)
days before the date set for said hearing. Such notices shali be pasted noe more than 30C, feee apart,
but at least three (3) shall be posted, and such notices shall siate the passage of this resolution
of intention and the time and place of rhe hereinabore mentToned hearins.
