RESOLUTION AND ORDER APPROVING AWENDED 'ENGINEER'S REPORT,
ORDERING THE CONSTRUCTION OF IMPROVEZENTE, AND CONFIRMING
ASSESSMENT, ASSESSTDDIT DIGTHECT NO. 67-1, CITY OF ALAMEDA,
ALAKEDA COUNTY. CALIFORNIA.
WHEREAS, on the 18th day of July, 1967, the City Council of the City- of Alameda, Alameda
County, California, adopted its Resolution of intontion, as amended, in Assessment District No.
67-1, City- of Alameda, Alameda County, California, for the construction of improvements in said
assessment district, and referred said proposed improvements to the City. Engineer of the City- of
Alameda; and
WHEREAS, on the 15th day of August, 1967, the 7 EnEineer filed an Engineer's Report,
Assessment and Assessment Diagram in accordance with said Resolution, and said Engineer's Report
was presented to the City Council of the City' of Alameda for consideration; and
WHEREAS, on the 15th day of' August, 1967, the City Council of the City of Alameda pre-
liminarily adopted said Engineer's kepoft and fixed Tuesday, the 19th day of September, 1967, at
the hour of 7:30 P.M. of said day, at the meeting place of the City Council of the City of Alameda
located in the City Hall as the time and place for hearing protests with relation to said proposed

WHEREAS, pursuant to said Resolution hereinabove mentioned a Notice of improvement was
duly published, posted and. mailed, giving notice of the time and place of hearing on said Report;
and
WHEREAS, on the 1.9th day- of September, 1967, said

WHEREAS, all protests having been overruled; and
WHEREAS, on the 3rd day of October, 1967, the City Council of the City of Alameda
directed the City Engineer of' the City of Almaeda to file an Amended Engineer's Report; and
WHEREAS, on the 3rd day of October, 1967, the City Engineer of the City of Alameda filed
with the City Clerk of the City of Alameda, an Amended Engineer's Teport;
NOW, THEREFORE, BE IT RESOLVED by the City Council of n.. City of Alameda, Alameda County,
California, that this Council does hereby find, detemine and order as follows:
1. That the district benefited by said improvements and to be assessed to pay- the costa
and expenses thereof, is more particularly descriaed in the Resolution of intention, as amended,
hereinabove referred to and made a an hereof by reference thereto. That, all public streets and
highways within said_ assessnant district, the same being in use in the performance of a public
function as such, shall be omitted from said district and from the levy and collection of the
special assessments to be hereafter levied a11 d. collected to cover the costs and expenses of said
dwprovanents.

2. That the plans and specifications for the proposed improvements be, amid they are
finally adopted and approved as the plans and specifications to thmich said work shall be
called for in said Resolution of intention, as amended.
3. That the Auended Estimate of Cost of the itemixed and total estimated costs and
expenses of the improvements and of the incisiental expenses in connection therewath, which said
Amended Estimate of Cost is on file tdth the City- Clerk of the Cipy of Alameda be, and it is hereby,
finally adopted and. approved as the Engineer's total and detailed estimate of the costs and
oxponsos of said improvements.
4, That the public converdence and interest roquiro, and said Council. hereby orders',
the improvements to be made as described in, and in accordance with, said Resolution of Intentien,
as amended, and the Amended Engineer's Report on. file with the City Clerk of the City of Alameda
reference to both. of -which is hereby- made for a more particular description of said. improvements
and also reference is hereby. made to the provisinns of the Municipal Improvement Act of 1913, as
amended.
5. The City Council of the City of Elameda does hereby levy and apportien upon each and
evenv let, piece and parcel of land within the boundaries of the assessment district the amount by-
which each of' said lots, pieces or parcels of land is benefited by the improvaments. The amount of
the assessment Which is levied and apportioned upon each and every lot, piece and parcel of land
within the boundaries of the assessment district is as shown on the assessment attached to and made
a part of the Amended Engineer's Report adapted. by tido Resolution. The City Council of the City of
Alameda hereby finds and determines that each of said lots, pieces or parcels of land wathin the
boundaries of said district is 04,10,4.30.1 14 amount and. in. the proportion of the total cost of
the improvements plus incidental expenses, which each of said lots, pieces or parcels of land has
been assessed in said Amended Engineer's Report,
6. In. the event any surplus remains in the improvement Fund after the completion of the
improvement and the payment of all claims from the improvement Fund, said surplus shall be trans-
ferred to the general fund of the City. if it does not ,'311 ,.1' leaser of $1,000.00 or 5 per cent
of the total amount expended from the improvement Fund; otherwise said surplus shall be applied as
a credit upon the assessment in the manner provided in Section 10427.1 of the Streets and Highways Code.
7. Collections of assessments shall be madE by the City Treasurer of the City of
Alameda.
