AUTHORIZING CITY ATTORNEY TO SETTLE CLAIM, EXECUTE COVENANT,
AND COMMENCE LEGAL PROCEEDINGS
WHEREAS, on August 9, 1968, the City's Master Fire Alarm Box No. 2424, located in the 2200
block on Alameda Avenue, was damaged in the sum of 51,037.00 by reason of the operation at that time
and place of two motor vehicles owned, respectively, by Robert A. Bourgeois and Edward G. Hoffman;
and
WHEREAS, there has been offered on behalf of the first-mentioned person payment of ore-half
of said sum (5518.50) in satisfaction of alleged liability on his part; and
WHEREAS, the City Attorney recommends acceptance of said sum and requests permission to
commence such proceedings as may be appropriate to collect the remainder of said damages;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
(1) The City Attorney be and he hereby is authorized, on behalf of the
City, to settle and compromise a claim by the City for the sum and in the manner
hereinabove referred to, and to execute a covenent not to sue upon receipt of
said amount;
(2) The City Attorney be and he hereby is authorized, on behalf of the
City to commence such proceedings as he deems appropriate to enforce payment of the
remaining one-half of said damage against said Edward G. Hoffman.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
2nd day of September, 1969, by the following vote, to wit:
AYES: Councilmen Levy, Longaker, McCall and President La Croix, Jr., (4).
NOES: None,
ABSENT: Councilman Fore, (1).
