E. 2105, AND ORDER APPROVING ASSESSMENT.
WHEREAS, William M. Bartley, Richard Blanchard and Jack F. Gallagher, the Assessment,
Commissioners appointed by this Council to view and assess upon the lands in Bay- Farm island
Deciamatien District No. 21c) the sum estinated to be the cost cf the Amended Reclamation Plan,
as amended, on file in the office of the City Clerk of said City and to apportion said sum
according to the benefits accruing to each parcel as provided by law, have completed such assess-
ment and have filed a list of charges assessed with the City Clerk of the City of Alameda as
required gy law, and this Council having appointed Tnesdayu the 2nd day of September, 1969, at
the hour of 7:E0 p.m. of said day, at the Council Chamber02 of the Council of the City of Alameda,
City Hall, Alameda, Elameda County, California, as the time and. place when and. where this Council
would meet for the purpose of hearing any objections to said assessment, and notice of such
hearing having been duly given by publication once a week for two successive mbeks in the Alameda
Times-Star, a newspaper of general circulation, published in the City of Alameda, County of
Alameda, State of California, and additional notice having been given by mailing written notice of
such hearing to each owner of land 10 ,0 District, and the mattwr of said assessment and the
objectiens thereto having come on regularly for hearing at said time and place; and
WHEREAS, at said time and place, by Resolution No. 7526, this Council upon the recam-
mendatien and wEth the condurrence of said Assessment Commissithers, having directed that. said
list of charges be changed, modilied and reappoftioned and caused a list of charges so changed,
modified and reapportioned to be filed cm September 2, 1969 with the City Clerk, ane this Council.

the Council Chambers of the Council of the City of Alameda, City hall, Alameda Alameda County,
California, as the time and place when. and where this Council wbuld meet for the purpose of hearing
any objections to said assessment, and notice of such hearing having been duly given by publication
once a week for two successive weeks in the Alameda limes-Star, a newspaper of general circulation,

haying been given by-mailing written notiro of such hearing to each ugner of lard in said District,
and the matter of said assessment and the objections thereto having come on regularly- for hearing'
at said time and place; and
WHFHEAS, four written objections to said assessment were filed. with. this Council, three
of wnich wore withdrawn upon request therefor by the persons fng said objections, leaving 0.ne
abjection to said assessment on file with and presented to this Council for its determination, to
the objection of Benedetto E. Matto, dbresa Batts, Thomas L. Ferro, Andrea Caviglia and
Catherina Cavdglia, claiming to be the owners of Parcel No. 3i, containing approximately 1.597 acres
and assessed in the sum of $14,C52.00; and
WHEREAS, saTi objection has been duly- heard and evidence, oral wnd documentary, having
been duly received and considered by this Council and the matter hawing been submitted te this
Council. for decision, the Council being duly advised, and it appearing to the Council that said
assessment has been made in accurdande wdth law and should be approved as filed;
ECM, tHREFORE, rizsCLVED AND (01 /1 ny the Council of the. City of Alarrrda , as
follows:
Section 1- Bay Farm Island Reclamation District No. 2105 has prepared and filed with this
Council an Amended Plan. of Declamation, together with an amendment thereto; that in accordance with
said. Amended Plan of Declamation, as amended, said District has reclaimed tidelands, entered into
contracts therefor, and has completed an extensive public improvement; that this Council did hereto-
fore appair Commissioners of Assessment and that said Commissioners of Assessment did. view the
lands to be assessed for the purpose of paying the cost of said wyrk of reclamation end have caused
the same to be spread upon all of the lands in the Dist/dot in. all respects as provided by law and
tho spreading of said aasessment ao hereby found and determined to be the result of dae contemplation
by said Assessment Commissioners of all elements necessary to arrive at a just apportionment of said
assessment and that said assessment and the list of charges assessed, as changed, therein contained
are, and each of them is, valid-
Section 2. All objections to said assessment and. to '01 ,01 of charges against each and
every- lot or parcel of land assessed as set forth on said assessment list be, and are hereby,
rejected and overruled.
Section 3. The above and foregoing assessment as set. forth on said assessment list. now- on
02 (311 the offize of the City- Clerk of the City of Alameda in. the EUM of $23,500,000 be, and. the
same is hereby, approved.
Sectimn 4. This order of approval of said assessment shall be endorsed upon the one
original and second original of said assessment list, as changed, and shall be signed by the Mayor
of the City of Alameda and attested by t City- Clerk thereof.
Section 5. Said assessment list having been prepared in duplicate, the one original shall.
be retained En the office of Bay Farm island Reclamation District, No. 2105 and the second original
shall forthwith be filed with the City Treasurer of the City of Alameda County of Alameda, State of
California.
