APPROVING APPLICATION OF HOUSING AUTHORITY OF THE CITY OF
ALAMEDA FOR PRELIMINARY LOAN FOR LOW-RENT PUBLIC HOUSING;
APPROVING THE DEVELOPMENT, CONSTRUCTION AND OWNERSHIP OF A
LOW-RENT HOUSING PROJECT OF NOT TO EXCEED 168 DWELLING UNITS;
AND APPROVING THE FORM OF COOPERATION AGREEMENT BETWEEN THE
CITY OF ALAMEDA AND HOUSING AUTHORITY OF THE CITY OF ALAMEDA
AND AUTHORIZING ITS EXECUTION
WHEREAS, it is the policy of the City of Alameda to eliminate substandard and inadequate
housing, to prevent the spread of slums, and to realize as soon as feasible the goal of e decent home
in a suitable living environment for all of its citizens; and
WHEREAS, under the provisions of the United States Housing Act of 1937, as amended, the
United States of America, acting through the Secretary of Housing and Urban Development, (herein called
"The Government") is authorized to provide financial assistance to local public housing agencies for
undertaking and carrying out preliminary planning of low-rent housing projects that will assist in
meeting this goal; and
WHEREAS, the Act provides that there shall be local determination of need for low-rent
housing to meet needs not being adequately met by private enterprise and that The Government shall not
make any contract with a public housing agency for preliminary loans for surveys and planning in respect
to any low-rent housing projects unless the governing body of the locality involved has by resolution
approved the application of the public housing agency for such preliminary loan; and
WHEREAS, the Housing Authority of the City of Alameda (herein called the "Local Authority")
is a public housing agency and is applying to The Government for a preliminary loan to cover the costs
of surveys and planning in connection with the development of low-rent housing; and
WHEREAS, Section 34313 of the California Health and Safety Code, as amended, provides that
no low-rent housing project shall be developed, constructed or owned by the Local Authority until the
governing body of the City of Alameda has by resolution approved such project; and
WHEREAS, pursuant to Section 15(7)(b) of the United States Housing Act of 1937, as amended,
it is necessary that the City of Alameda enter into a Cooperation Agreement with the Local Authority
providing for local cooperation in connection with such low-rent housing project; and
WHEREAS, pursuant to and in compliance with the provisions of Section 34518 of the California
Health and Safety Code, the City Council of the City of Alameda did on May 5, 1970, adopt its Resolu-
tion Number 7613 authorizing the publication in the Alameda Times Star, a newspaper of general circula-
tion, on May 11, 1970, and on May 20, 1970, of a notice of a public hearing to be held June 3, 1970,
before the City Council for the purpose of giving all interested persons an opportunity to be heard as
to whether such Cooperation Agreement should be entered into; and the City Clerk of the City of Alameda
has had available at least three copies of the proposed Cooperation Agreement for inspection by interest-
ed persons prior to the mentioned public hearing; and
WHEREAS, the notices for a public hearing have been published as above provided, and the City
Council of the City of Alameda has held a public hearing starting at the hour of 7:30 p.m. on the 3rd
day of June, 1970, giving all interested persons an opportunity to be heard as to whether the proposed
Cooperation Agreement in the form hereinafter set forth should be entered into, which said hearing has
been concluded with all matters in connection therewith having been fully considered by the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALAMEDA AS FOLLOWS:
1. There exists in the City of Alameda a need for such low-rent housing at rents within the
means of low-income families.
2. The application of the Local Authority to the Government for a preliminary loan in an
amount not to exceed 567,200.00 for surveys and planning in connection with a low-rent housing project
of not to exceed 168 dwelling units in the area containing approximately 7.5 acres, now known as Western
Project, at Third and Brush Streets in the City of Alameda, is hereby approved.
3. The City Council does hereby approve the development, construction and ownership by the
Local Authority of said project as defined in the Cooperation Agreement which was heretofore filed in
the office of the said City Clerk on May 5, 1970.
4. The City Council, after having held a public hearing and giving all interested persons
an opportunity to be heard, hereby determines, pursuant to the provisions of the California Housing
Cooperation Law (being Chapter 2 of Part 2 of Division 24 of the California Health and Safety Code), to
enter into a Cooperation Agreement with the Local Authority, in substantially the form hereinafter set
forth. The Mayor of the City of Alameda is hereby authorized and directed to execute such Cooperation
Agreement in the name and on behalf of the City of Alameda and the City Clerk is hereby authorized and
directed to affix or impress the official seal of the City of Alameda thereon and to attest the same.
Such Cooperation Agreement shall be in substantially the form of that heretofore on file in the Office
of the said City Clerk and marked "Filed May 5, 1970."
5, This Resolution shall become effective innediately.
