Resolution 07748CITY OF ALAMEDA RESOLUTION NO. 7748 DECLARING CANVASS OF RETURNS AND RESULT OF GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH SPECIAL MUNICIPAL CHARTER AMENDMENT ELECTION HELD ON MARCH 9, 1971 WHEREAS, a General Municipal Election consolidated with a Special Municipal Charter Amendment Election was held in the City of Alameda on Tuesday, March 9, 1971, under and pursuant to the provisions of Article XIX of the Charter of said City, for the purpose of electing officers to fill the offices of Mayor, Councilman, Auditor and member of the Board of Education, and for the purpose of submitting to the qualified electors of said City the question of amending the Charter of the City of Alameda, as set forth hereinafter: One (1) Mayor on the Council of said City for one (1) full term commencing et 8:00 o'clock p,m., on the third Tuesday in April, 1971, and continuing for four (4) years thereafter, and until a successor is elected and qualified; One (1) Councilman on the Council of said City for one (1) full term commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for four (4) years thereafter, and until a successor is elected and qualified; One (1) Auditor of said City for one (1) unexpired term commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for two (2) years thereafter and until a successor is elected and qualified. Two (2) members of the Board of Education to fill the office for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for four (4) years thereafter, and until a successor is elected and qualified. MEASURE A Shall the Charter of the City of Alameda be amended to provide that employees of the City (other than certain officers thereof who are required to reside in the City) shall reside within the City or within such distance of the City limits as the City Council shall prescribe by ordinance? The Charter presently requires such employees to reside within the City or within fifteen miles of the City limits. Said amendment will be accomplished by amending Section 2-5 of said Charter, all as fully set forth in Resolution No. 7721 of the Council of the City of Alameda. WHEREAS, nominating petitions were duly and regularly presented to, and filed in the office of the City Clerk of the City of Alameda, in the time, form and manner prescribed by the Charter of said City, nominating for said offices the following persons, to wit: FOR THE OFFICE OF MAYOR: Terry Y. La Croix, Jr. James W. Fore Ronald O. Livesey FOR THE OFFICE OF COUNCILMAN: William M. McCall Grant W. Payne FOR THE OFFICE OF AUDITOR: Raymond D. Martin FOR THE OFFICE OF MEMBER OF THE BOARD OF EDUCATION: Marion W. Cavanaugh Barbara W. Bolton Lee S. Simpson III Ian Weber WHEREAS, said nominations were entered in a list, with the offices to be filled, which list was certified to and filed in the time, form and manner required by said Charter, whereupon an Election Proclamation, signed by the Mayor of the City of Alameda, and attested by the City Clerk, and containing a statement of the time of the election, the offices to be filled, the names of the candidates and the measure to be voted on, as the same were, by the Council of the City of Alameda, ordered to be printed and appear on the ballot, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said City, the last publication thereof being more than five (5) days before the date of said election; and WHEREAS, there were 60 election precincts within the City of Alameda fixed and designated by resolution of the Council of said City and designated, fixed and established by the Board of Supervisors of the County of Alameda, State of California, as the election precincts within the City of Alameda for holding general state and county elections - as the election precincts for holding the aforesaid General Municipal Election consolidated with Special Municipal Charter Amendment Election of the City of Alameda; and WHEREAS, all of the ballots used for said election were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time 169 and in the manner provided by law and such mailing was completed at least ten (10) whole days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and WHEREAS, the Council of the City of Alameda, at this, its next regular meeting following said election, has met and fully canvassed the returns of the votes cast at said General Municipal Election consolidated with Special Municipal Charter Amendment Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as follows: (1) That said General Municipal Election consolidated with Special Municipal Charter Amend- ment Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (2) That the number of votes given at each precinct to each of the aforesaid candidates and measure was es shown in the Result of Votes Cast, on file in the office of the City Clerk, copy of which is attached hereto. (4) That the total number of votes cast in the City of Alameda at said election for each of the aforesaid candidates for the office of Mayor of said City was as follows: Terry Y. Livesey 960 (5) That the total number of votes cast in the City of Alameda at said election for each of the aforesaid candidates for the office of Councilman of said City was as follows: William M. McCall 6,006 Grant W. Payne 5,446 (6) That the total number of votes cast in the City of Alameda at said election for the office of Auditor of said City was as follows: Raymond D. Martin 10,277 (7) That the total number of votes cast in the City of Alameda at said election for each of the aforesaid candidates for the office of member of the Board of Education of said City was as follows: Marion W. Cavanaugh Barbara W. Bolton Lee W. Simpson III 5,019 4,721 6,588 Ian Weber 4,749 (8) That the total number of votes cast in the City of Alameda at said election for the afore- said measure was as follows: Measure 9 Yes: 7,661 ko: 3,502 170 NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED that the aforesaid Terry Y. LaCroix, Jr., having received the highest number of votes cast for the office of Mayor, was, and is hereby declared to be, duly and regularly elected to the office of Mayor and as member of the Council of the City of Alameda, for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for for (4) years and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid William M. McCall, having received the highest number of votes cast for the office of Councilman, was, and is hereby declared to be, duly and regularly elected to the office of Councilman and as member of the Council of the City of Alameda for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for four (4) years and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Raymond D. Martin, having received the highest number of votes cast for the office of Auditor was, and is hereby declared to be, elected to the office of Auditor for the term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for two (2) years and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Lee S. Simpson III and Marion W. Cava- naugh, having received the two highest numbers of votes cast for the office of member of the Board of Education, were, and are hereby declared to be, duly and regularly elected to the office of member of the Board of Education of the City of Alameda, each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1971, and continuing for four (4) years and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid measure, having received a majority of the number of votes cast, was, and it is hereby declared to be, passed. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 16th day of March, 1971, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5)• NOES: None.
