Resolution 07991454 CITY OF ALAMEDA RESOLUTION NO. 7991 APPROVING FINAL MAP OF CONDOMINIUM SUBDIVISION KNOWN AS TRACT 339.1, AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, AND APPROVING CASH DEPOSIT AS TO SUFFICIENCY IN LIEU OF SURETY PERFORMANCE BOND (2426 LINCOLN AVENUE -- D. B. BITNER CO., INC., SUBDIVIDER) WHEREAS, there has been heretofore filed with and approved by this Council a Tentative Map of that certain proposed condominium subdivision known as Tract 3391; and WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, D. B. Bitner Co., Inc., a California corporation, Subdivider herein, has presented to this Council a Final Map of the said 10-unit condominium subdivision known as Tract 3391; and WHEREAS, said subdivider has entered into an agreement with the City to construct and complete the public improvements in said subdivision and has posted and deposited in lieu of a surety performance bond a cash bond in the sum of $10,000.00 to guarantee full and faithful performance of said work, all in accordance with said Article; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3391, be and hereby is approved. BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to, respectively, said agreement on behalf of the City. BE IT FURTHER RESOLVED that said cash bond, in lieu of a performance bond, guaranteeing full and faithful performance of the subdivider's said public improvements construction contract, is hereby approved as sufficient in amount. * * * * * * * * * the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of October, 1972, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
