Resolution 07995458 CITY OF ALAMEDA RESOLUTION NO. 7995 ACCEPTING DEVISE OF REAL PROPERTY FROM ESTATE OF EDITH Ni , MEYERS (2021 ALAMEDA AVENUE - PARK PURPOSES) WHEREAS, under the last will and testament of Edith M. Meyers there was devised to the City of Alameda, subject to certain preceding trusts for the benefit of said deceased's surviving sisters, all that real property commonly designated as 2021 Alameda Avenue, Alameda, California, which property constituted the residence of deceased; and WHEREAS, proceedings are presently pending in the Superior Court of the State of Cali- fornia for the County of Alameda, under file No. 191358, seeking probate of the Estate of Edith M. Meyers, deceased, whose said will, in Article Eleventh C.1. thereof, provides for transfer of said property, upon the happening of named continnencies, to the City of Alameda, upon the following conditions, among others: (a) the property shall be used as a neighborhood park to be created by the City; (b) the house thereon shall be used as a Club House or Administration Headquarters only, and maintained therefor in good condition; (c) the property shall be kept in good condition by the City; (d) the City shall affirmatively accept said devise prior to November 12, 1972; and (e) the property shall divest and revert to named remaindermen if not used according to the conditions of the devise, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that pursuant to Section 22-10 of its Charter, the City of Alameda, a municipal corporation, does hereby accept the devise of real property, commonly known as 2021 Alameda Avenue, hereinabove referred to, said acceptance being in full accordance with all of the terms and conditions thereof; and BE IT FURTHER RESOLVED that the Mayor be and he hereby is authorized to consent to the acceptance of any conveyance evidencing said devise, for all purposes including recordation thereof, pursuant to Section 27281, Government Code of California; and BE IT FURTHER RESOLVED that this resolution shall be deemed in compliance with Article Eleventh C.1.d. of said will and testament. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in adjourned regular meeting assembled on the 24th day of October, 1972, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker and McCall, (4).
