AMENDING RESOLUTION NO. 7959 BY ADDING A NEW SECTION 2
THERETO, RELATING TO WORKING HOURS, OVERTIME, UNIFORM
ALLOWANCES AND EDUCATIONAL INCENTIVE AWARD PROGRAM FOR
EMPLOYEES
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that Resolution No. 7959, adopted
July 14, 1972, is hereby amended by adding Section 2, to read:
SECTION 2
1. VACATION RELIEF, SICK LEAVE RELIEF, PART-TIME EMPLOYMENT
Any of the above listed classes, subject to the availability of budgeted funds, may be filled
on a temporary or part-time basis for vacation relief, sick leave relief, and authorized part-
time-employment.
Alen, subject to the availability of budgeted funds, when a permanent position is to be vacated
and it is necessary to train a replacement, or for other valid reason, one additional position
in any of the above classes may be filled by Civil Service appointment, subject to the approval
of the City Manager.
2. SCHEDULE OF DUTY HOURS PER WEEK
A. Police Department. The duty week for all sworn and non-sworn uniformed personnel shall
be 40 hours. The duty week for miscellaneous clerical personnel shall be 37.5 hours.
B. Fire Department. The duty week for all sworn uniformed members whose normal tour of duty
is for 24 consecutive hours shall average 56 hours per week, as shall be scheduled by the
Chief of the Department. The duty week for sworn members on regular assignment to the
Fire Prevention Bureau shall be 5 consecutive days of 8 hours each, or 40 hours per week.
In case such a member is serving in an acting capacity for a member in a higher rank
whose duty week is 56 hours, and such member is qualifying for or eligible to receive
acting pay, as provided for elsewhere, such member shall not be entitled to overtime in
addition to acting pay for hours in excess of 40, except under circumstances where over-
time provisions would apply to the member whose place is being taken.
The duty week for non-sworn uniformed personnel shall be 40 hours. For miscellaneous
clerical personnel it shall be 37.5 hours.
C. Library, Public Works, Recreation, Park and Golf Departments. The normal duty week for
full-time employees in the Public Works, Recreation, Park and Golf Departments, and for
part-time employees in the Library shall be, or shall be computed at an hourly rate on
the basis of 40 hours, except as provided under (D), below.
D. City Hall, Administrative, Library and Related. The duty week for personnel, except as
provided under (A) and (C) above, whose normal base of operations is the City Hall or
the Library, shall be 37.5 hours, except where the nature of the duties is such that a
40 hour duty week is required because of the inter-relationships with other City Depart-
ments or personnel where the duty week is 40 hours. This determination shall be made by
the City Manager upon the recommendation of the Department Head involved. In no case is
it intended that any employee, regardless of Department or location, whose duty week is
currently 37.5 hours, shall have it extended beyond this figure.
3. EDUCATIONAL INCENTIVE PROGRAM
A. Each sworn member of the Police Department below the rank of Police Captain who qualifies
for a Training Incentive Award in accordance with the administrative directive entitled,
"Regulations Governing the Training Incentive Program," shall receive, so long as such
qualifications are retained, an award in the amount of $65.00 per month.
B. Each full-time City employee below the position of Division Head, not included in subpara-
graph (A) above, who qualifies for educational reimbursement in accordance with the
administrative directive entitled, ''Regulations Governing the Education Reimbursement
Program" shall receive, so long as such qualifications are retained, reimbursement for
certain approved educational costs as tuition fees, laboratory fees, costs of textbooks,
and mileage, in a sum not to exceed $200.00 annually, unless any excess thereof has first
been authorized in writing by the City Manager.
4. UNIFORM ALLOWANCE
A. Police Department. All sworn members of the Police Department, except the Chief of Police,
shall receive a sum of money in the amount of $190.00 annually as uniform allowance. Non-
sworn personnel employed in the Police Department who are required to wear a distinctive
uniform shall receive a sum of money in the amount of $100.00 annually as allowance therefor.
B. Fire Department. All uniformed members of the Fire Department, except the Fire Chief,
shall receive a sum of money in the amount of $150.00 annually as uniform allowance. Said
allowance to members of the Fire Department shall be in lieu, and take the place, of the

uniform .damage replacement program heretofore in effect in said Department, except as
to necessary non-uniform items damaged in the direct performance of duty.
The allowances provided for under 4A and 48 above shall be paid quarterly, commencing
July 1, 1971.
C. Crossing Guards. All regularly scheduled Crossing Guards with more than six months'
City employment shall receive a single payment of $46.00 as cost of a uniform. Replace-
ment of worn or damaged uniforms of such Guards shall be at City cost upon the written
authorization of the Chief of Police,
D. Other Departments. Full-time employees of all Departments, except those enumerated in
paragraphs A and 6 above, shall be eligible for special protective clothing at City cost
upon the written authorization of the affected Department Head and approval of the City
Manager. "Special protective clothing" shall be only those garments or clothing
articles necessary to protect the usual work clothing, which the employee normally wears
to and on the job, from unusual hazards or from unusual wear and tear.
5. OVERTIME PAY
A. Police Department.
1. For sworn personnel at or below the rank of Police Sergeant, time and one-half
shall be paid for all overtime worked subsequent to July 1, 1970, which exceeds
an accumulation for each member of 48 hours. For each employee who has already accum-
ulated more than 48 hours of overtime prior to July 1, 1970, he shall be compensated
only for overtime in excess of his current overtime accumulation, with the provision
that, to the extent unexpended funds from the Police Department Personal Services
budget for fiscal year 1970-1971 become available, and pursuant to prior approval
of the City Manager, such funds may be used to compensate for such overtime in excess
of 48 hours previously accumulated.
With the approval of the Chief of the Department, a member may choose compensatory
time off, at time and one-half, in lieu of overtime pay.
Except es otherwise provided by Section 2, subparagraph C of Resolution 6232, a
sworn member at or below the rank of Police Sergeant who is called upon to perform
work on his regular day off, or on a regular work day but not contiguous with his
regular shift, shall be guaranteed a minimum of 4 hours overtime to his credit.
iii When a sworn officer at or below the rank of Sergeant, or a Police Aide, is required
by the Department or by State law to attend a training class on his regular day off,
or on his regular duty day but not contiguous with his regular shift, he shall be
guaranteed a minimum of two hours overtime at straight time which shall be paid or
taken off in accordance with existing policy and regulations.
When a sworn officer at or below the rank of Sergeant, or a Police Aide, is required
by the Department or by State Law to attend a Training class contiguous with his
regular duty shift, he shall be guaranteed a minimum of one hour overtime at straight
time, with the understanding that there may be, at the Department's discreation, a
break of less than 15 minutes between the beginning or end of the duty shift and
the beginning or end of the one-hour training period. Such overtime shall be paid
or taken as time off in accordance with existing policy and regulations.
8. Fire Department.
i. For sworn personnel at or below the rank of Fire Captain, time and one-half shall be
paid for all overtime worked subsequent to July 1, 1971, which exceeds an accumulation
for each member of 24 hours.
ii. Required attendance at educational or training courses during a member's off-duty
period shall be compensated for as overtime. A member who becomes eligible for
overtime under this section shall not, in addition, be eligible for benefits under
the Educational Reimbursement Plan for required in-service training courses.
iii. Except as otherwise provided by Section 2, subparagraph C of Resolution 6232, a
sworn member at or below the rank of Fire Captain who is required to be on duty on
his regular day off, or on a regular duty day contiguous with his regular duty shift,
shall be guaranteed a minimum of two hours overtime to his credit, with the provi-
sion that less than 15 minutes overtime at the beginning or end of the duty shift
shall not be credited as overtime for the purposes of pay or time off.
C. Other Departments
Except as otherwise provided by Section 2, subparagraph C of Resolution 6232, each full-
time City employee, below the position of Division Head, not included in subparagraphs
A and B above, who is required to work on his regular day off, or on a regular work day,
but not contiguous with his regular shift, shall be guaranteed a minimum of two hours
overtime for such work at time and one-half.
6. STANDBY PAY
For sworn police employees at or below the rank of Police Sergeant, such personnel shall be
credited with one-half of the employee's regular hourly salary rate while on emergency on-call
status, that is, a non-duty status where an employee is required to be available and on call,
and may actually be called to duty by the Police Department during an emergency, or an anti-
cipated emergency. Any monies received by employees from the implementation of this policy
shall not be considered pay, salary, or compensation for the purpose of calculating present
or future pension benefits.
