Resolution 08043CITY OF ALAMEDA RESOLUTION ND. 8043 DECLARING CANVASS OF RETURNS AND RESULT OF GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH SPECIAL MUNICIPAL CHARTER AMEND- MENT ELECTION HELD ON MARCH 13, 1973 WHEREAS, a General Municipal Election consolidated with a Special Municipal Charter Amend- ment Election was held in the City of Alameda on Tuesday, March 13, 1973, under and pursuant to the provisions uf Article XIX of the Charter of said City, for the purpose of electing officers to fill the offices of Councilman, Auditor, Treasurer and member of the Board of Education, and for the purpose of submitting to the qualified electors of said City the question of amending the Charter of the City of Alameda, as set forth hereinafter: Three (3) Councilmen on the Council of said City for three (3) full terms commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years thereafter and until a successor is elected and qualified; One (1) Auditor, to fill the office for one (1) full term commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years thereafter and until a successor is elected and qualified; One (1) Treasurer, to fill the office for one (1) full term commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years thereafter and until a successor is elected and qualified; Three (3) members of the Board of Education, to fill the office for three (3) full terms commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years thereafter and until a successor is elected and qualified. MEASURE A Shall the Charter of the City of Alameda be amended to provide that there shall be no multiple dwelling units built in the City of Alameda, exception being the Alameda Housing Authority replacement of existing low cost housing units and the proposed Senior Citizens low cost housing complex, pursuant to Article XXV of said Ch.arter? Said amendment will be accomplished by adopting Sections 26-1 and 25-2 of a new Article XXVI thereof, all as fully set forth in Resolution No. 8017 of the Council of the City of Alameda. WHEREAS, nominating petitions were duly and regularly presented to, and filed in the office of the City Clerk of the City of Alameda, in the time, form and manner prescribed by the Charter of said City, nominating for said offices the follscing persons, to wit: FOR THE OFFICE OF OOUNCILMAN: James W. Martin FOR THE OFFICE OF TREASURER: Ellen Schmalenberger FCR THE OFFICE OF MEMBER Of THE BOARD OF EDUCATION: Joyce M. Denyven James L. Nolin Inc Weber George D. Gammell WHEREAS, mid nominations were entered in a list, with the offices to he filled, which list was certified to and filed in the tiffle, Torn' and manner required by said Charter, whereupon an Election Proclamation, signed by the Mayor of the City of Alameda, and attested by the City Clerk, and containing e statement uf the time of the election, the offices to be filled, the names of the candidates and the measure to he voted on, as the same ware, by the Council of the City of Alameda, ordered to be printed and appear on the ballot, was duly and regularly issued more than ten (10) days before said election and was published twice in the official newspaper of said City, the last publication thereof being more than five (5) days before the date 03 said election; and WHEREAS, there were GS election precincts within the City of Alameda fixed and designated by resolution of the Council of said City and designated, fixed and established by the Board of Super- visors of the County of Alameda, State of California, as the election precincts within the City of Alameda for holding general state and county elections - as the election precincts for holding the aforesaid General Municipal Election consolidated with Special Municipal Charter Amendment Election of the City of Alameda; and WHEREAS, all of the ballots used for said election were prePared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten (10) whole days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for each precinct as provided by law; and WHEREAS, the Council of the City of Alameda, at this, its next regular meeting following said election, has met and fully canvassed the returns of the votes cast at said General Municipal Election consolidated with Special Municipal Charter Amendment Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OE ALAMEDA and said Council finds, as follows: (1) That said General Municipal Election consolidated with Special Municipal Charter Amend- ment Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law, (2) That the number of votes given at each precinct to each of the aforesaid candidates and measure was as shown in the Result of Votes Cast, on file in the office of the City Clerk, copy of which is attached hereto. Beckam, Jr., Carmelo J. "Chuck" Corica and Lloyd E. Hurwitz, having received the three highest numbers of votes cast for the office of Councilman and as members of the Council of the City of Alameda, each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years and until a successor is elected and qualified; IT FURTHER RESOLVED AND DECLARED that the aforesaid Raymond D. Martin and Ellen Schwalenberger, having each received the highest number of votes cast for the offices of Auditor and Treasurer, respectively, were, and they are hereby declared to be, duly ard regularly elected to the offices of Auditor and Treasurer, respectively, of the City of Alameda for terms beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (d) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Joyce N. Denyven, James L. Nolin and Ian Weber, having received the three highest numbers of votes cast for the office of member of the Board of Education, were, and are hereby declared to be, duly and regularly Elected to the office of member of the Board of Education of the City of Alameda, each for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1973, and continuing for four (4) years and until a successor is elected and qualified; SE IT FURTHER RESOLVED AND DECLARED that the aforesaid measure, having received a majority of the number of votes cast, was, and it is hereby declared to be, passed. * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by tha Council of the City of Alameda in regular meeting assembled on the 20th day of March, 1973, by the following vote, to wit: AYES: Councilmen Fore, Levy, LongaFer, McCall and President Le Croix, Jr., (8).
