APPROVING FINAL NAP OF CONDOMINIUM SUBDIVISION KNOWN AS
TRACT 3517, AUTHORIZING EXECUTION OF AGREERENT FOR CON-
STRUCTICN OF PUBLIC HIPROVEPENTS THEREIN, ACCEPTING CER-
TAIN EASaENTS, AND APPROVING FAITHFUL PERFORMANCE BOND
A2 TO SUFFICIENCY (1170 NINTH STRaT — L, G, & W, INC.,
SUBDIVIDER)
3000113, there has been heretofore filed with and approved by this Council a Tentative
Map of that, certain proposed condominium subdivision known as Tract 3517, an existing 36—unit
apartment complex located at 1170 Ninth Street; and
HHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code,
L, G, & W, Inc., a California corporation, Subdivider herein, has presented to this Council
a Final Map of the said condominium subdivision known as Tract 3517; and
WH30EA:3, said Subdivider has entered into an agreement with the City to construct and
complete the public improvements in said subdivision and to post with the City Clerk its bond
in the amount of V7,000.00 to guarantee full and faithful performance of said work, a]1 in
accordance with said Article; and
13131E13, said Final Map delineates thereon certain easements dedicated for public use;
NOW, TREEEFORE, BE IT RESOLVED HY THE COUNCIL OF THE CIIT CF ALAMEDA that the Final
Mao of Tract 3517, be and hereby is approved.
33 IT FURTHER RESOLVED that the agreement for construction and completion of the public
improvements in said subdivision, and all its terms and conditions, be and hereby is approved,
and the City Manager and the City Clerk are authorized and directed to execute and attest to,
respectively, said agreement on behalf of the City.
BE IT FURTHER RESOLVED that said easements dedicated for public use are hereby accepted,
on behalf of the public, in conformity with the terms of the offer of dedication.
BE IT FURTHER RESOLVED that notice is hereby given that aaid agreement prohibito
occupancy of any building or dwelling within said subdivision until all the improvements mentioned
in said agreement have been fully completed by the Subdivider.
0E IT FURT1023. RESOLVED that the bond in the cum of $7,000.00, guaranteeing full and
faithful performance of the Subdivider's said public improvements construction contract, is
hereby approved as sufficient in amount.
