EMPLOYING SPECIAL LEGAL COUNSEL TO ADVISE CITY ON
ENVIRONMENTAL AND OTHER ISSUES RELATING TO BAY FARM
ISLAND PROJECT, AND AUTHORIZING PAE8ENf OF COSTS
THEREFOR
WHEREAS, at its regular meeting of January 18, 1974, the City Council. adopted the
following Minute Order as moved by Councilman Hurwitz:
"Given the complexity and gravity of the issues naming before this
Council In future weeks, with their serious effects on Alameda's environ-
ment, feel it appropriate at this time that all avenue: en-
abling this Council to ascertain the alternatives before any deci.s
are reached.
"This Council in the very near future will be struggling with issues
such as Zoning, Environmental impact Report Evaluation, Airport Expansion
and its resultant impacts, as well as possibly City involvement in liti-
gation concerning these matters.
"I would therefore move that the Council a,nthorize and direct, on
behalf of the City, that the City Manager and City Attorney be directed
to contract with an environmental attorney to aid the City Attorney and
advise the Council on decisions affecting the City's environment. I further
request that this action be undertaken with the utmost expediency, in or-
der that we may be advised prior to our forthcoming decision concerning
the rezoning of Bay Farm Island.
"Under normal circumstances, I would hesitate to recommend action
invol -cing additional costs tothe City, however minimal. But, in consid-
eration of the gravity of these decisions and their effect on Alaneda'.s
entire future, with possible litigation against the City and associated
costs, it is only prudent that this safeguard be taken. In the final
analysis this would nave the City possible enormous future expense,"
WHEREAS, following adopting of said motion this Council authorized and directed
the City Manager and the City Attorney to employ, for the purposes of carrying out the intent
of said Order, Gary J, Near, Esq., Attorney at Law, whose business address is 473 Jackson Street,
San Francisco, California, as the City's special legal counsel, who has agreed to undertake such
representation as an independent advisor to this Council on the matters referred to;
NOW THEREFORE, HE IT RESOLVED BY THE COUNCIL OF THE OITY OF ALASEDA that Gary J. Near,
Esq., Attorney at Lam, is hereby employed, effective January 16, 1974, as special counsel to
advise the City Council on the environmental and other issues now before the City relating to
the proposed Bay Farm Island development project now pending; and
BE IT FURTHER RESOLVED that said special counsel shall receive, and be paid fortnwit.h,
the sum of One Thousand Five Hundred and no /100 Dollars ($1,500.00) an a retainer for such
representation, and shall receive, and be paid Further, the amount of Forty Dollars ($Z.D.00)
per hour for each hour devoted by him to the work necessary therein. The fees based upon such
hourly rate shall be itemized and submitted to this Council, not :Less than monthly, for approval.
BE TT FURTHER RESOLVED that the Auditor is hereby auth
retainer fee to said counsel forthwith, and the sums representing
approval by the Council of submitted invoices therefor.
