Resolution 083223 CITY OF ALAMEDA RESOLUTION No, 8322 DECLARING CANVASS OF RETURNS AND RESULT OF GENERAL MUNICIPAL ELECTION CONSOLIDATED WITH SPECIAL SCHOOL DISTRICT BOND ELECTION AND SPECIAL MUNICIPAL CHARTER AMENDMENT ELECTION HELD ON MARCH 11, 1975 WHEREAS, a General Municipal Election consolidated with a Special School District Bond Election and Special Municipal Charter Amendment Election was held in the City of Alameda on Tuesday, March 11, 1975, under and pursuant to the provisions of Article XIX of the Charter of said City, for the purpose of electing officers to the offices of Mayor, Councilman and Member of the Board of Education, and for the further purpose of submitting to the qualified electors of said City the question of the Alameda Unified School District of Alameda County incurring a bonded indebtedness and the further question of amending the Charter of the City of Alameda, as set forth hereinafter: One (1) Mayor of the said City for a full term commencing at 8:00 o'clock p.m., on the third Tuesday in April, 1975- and continuing for four (4) years thereafter and until a successor is elected and qualified; One (1) Councilman on the Council of said City for a full term commencing at 8:00 o'clock p.m. on the third Tuesday in April, 1975, and continuing for four (4) years thereafter and until a successor is elected and qualified; TWO (2) members of the Board of Education, to fill the office for two (2) full terms commencing at 8:00 o'clock p.m„ on the third Tuesday in April, 1975, and continuing for four (4) years thereafter and until a successor is elected and qualified. MEASURE A Shall the Alameda Unified School District of Alameda County incur a bonded indebtedness In the principal amount of Four Million Seven Hundred Fifty Thousand Dollars ($4,750,000) to bear interest at a rate or rates not exceeding 80 per annum payable annually the first year and thereafter semi- annually, to provide funds for the demolition and replacement of the following school buildings at Alameda High School which have been determined to he structurally unsafe in the event of an earthquake; the three-storm east building, the three-story main classroom building, the auditorium, gymnasium, boys and girls shower-locker rooms and two sfriall administration buildings, said amount of bonds (together with funds to be provided by the State of California) being sufficient to provide replacement of the above-mentioned school buildings, all in accordance with the plan of this Board on file in its office? MEASURE cio Shall the Charter of the City of Alameda be amended by deleting the first sentence of Section 2-5 which reads as follows: No person shall be qualified to he elected or appointed tc any of the elective offices herein- above set forth unless he shall have been an elector of the City cf Alameda for a period of three years continuously next preceding his election." Said amendment will he accomplished by amending Section 2-5 of said Charter, all as fully set forth in Resolution No. 8306 of the Council of the City cf Alameda. WHEREAS, nominating petitions were duly and regularly presented to and filed in the office of the City Clerk of the City of Alameda, in the time, form and manner prescribed by the Charter of said City, nominating for said offices the following persons, tc wit: FOR THE OFFICE OF MAYOR: George J. Ca:panic James Maresca Rosalie McPherson Richard IL Sherratt FOB THE OFFICE OF MEMBER CF THE BOARD CT EDUCATION: Barbara M, Borden Ronald I. Curtis Gary Johnson Ann V. Muir Robert J. Selmer WHEREAS, said nominations were entered on a list, with the offices to be tilled, which list Wes certified to and filled in the time, form and manner required by said Charter, whereupon an Election Proclamation, signed by the Mayor of the City of Alameda, and attested by the City Clerk, ard containing a statement of the time of the election, the offices to be filled, the names of the candidates and the measures to be voted on, as the same were, by the Council of the City of Alameda, ordered to he printed and appear or the Pallot, was duly and regularly issued more than ter (10) days before said ellection and was published twice in the official newspaper of said City, the last publi- cation thereof being more than five (5) days before the date of said election; and WHEREAS, there were 71 election precincts within the City of Alameda fixed and designated by resolution of the Council of said City and designated, fixed and established by the Board of Supervisors of the COUrity 7f Alameda, Stacha of Califeroja, as tho oct7on precinchs witavo tn.e blry of Alameda for 1i 1 'iis onPral state and county elections - as the election precincts for holding the aforesaid General Municipal Election consolidated with Special School District Bond Election and Special Municipal Charter Amendment Election of the City of Alameda; and WHEREAS, all of the ballots used for said election were prepared, as to form and contents, as prt,scribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the manner provided by law and such mailing was completed at least ten (10) whole days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all electiun supplies furnished and election booths provided for each precinct as provided by law; and WHEREAS, the Council of the City of Alameda, at this, its next regular meeting following said election, has met and fully canvassed the returns of the votes cast at said General Municipal Election consolidated with Special School District Bond Election and Special Municipal Charter Amend- ment Election as required by law, and being fully advised in the premises, and having the returns of said canvass before it NOW, THEREEDRE, BE IT RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as follows: (1) That said General Municipal Election consolidated with Special School District Bond Election and Special Municipal Charter Amendment Election was held and conducted, and the votes cast thereat received and canvassed, and the returns thereof ascertained, determined and declared, in all respects and particulars in the time, form and manner provided by law. (2) That the number of votes given at each precinct to each of the aforesaid candidates and measures was as shown in the Results of Votes Cast, on file in the office of the City Clerk, copy of which is attached hereto. J. "Chuck" Corica, having received the highest number of votes cast for the office of Mayor, is, and he is hereby declared to he, duly and regularly elected to the office of Mayor cf the City of Alameda for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1975, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Richard H. Sherratt, having received the highest number of votes cast for the office of Councilman is, and he is hereby declared to be, duly and regularly elected to the office of Councilman of the City cf Alameda for a term beginning at 8:00 o'clock p.m., on the third Tuesday in April, 1975, and continuing for four (4) years thereafter ard until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Barbara M. Borden and Ann M. Muir, having received the two highest numbers of votes cast for the office of member of the Board of Education, were, and are hereby declared to be, duly and regularly elected to the office cf member of the Board of Education of the City of Alameda, each for a term beginning at 8:00 o'clock p.m,, on the third Tuesday in April, 1975, and continuing for four (4) years thereafter and until a successor is elected and qualified; BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Measure A, not having received a majority of the number of votes cast, was, and it is hereby declared to be, defeated. BE IT FURTHER RESOLVED AND DECLARED that the aforesaid Measure B, havino received a majority of the number of votes cast, was, and it is hereby declared to be, passed. * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of March, 1975, by the following vote, to wit: AYES: Councilmen Corica, Hurwitz, McCall and President La Croix, Jr., (d).
