CITY OF ALAMEDA, RESOLUTION NO, 8417
DECLARING INTENTION OF COUNCIL TO ORDER VACATION OF PORTION
OF BLANDING AVENUE, A PUBLIC STREET IN THE CITY OF ALAMEDA,
AND REFERRING TO A CERTAIN MAP FOR PARTICULARS THEREOF
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that it is the intenticn of the
Council of the City of Alameda to order the vacation cf an improved portion of a public street, being
a portion of Blanding Avenue containing 0.0785 acres more or less, and more particularly described
as follows:
Real property in the City cf Alameda, County of Alameda, State of
California, described as follows:
COMMENCING et the intersection of the Northeastern line of Blanding Avenue with the
Southeastern line of Broadway;
THENCE along said Northeastern line of Blanding Avenue South 55' 36' 03" East
266.70 feet to the point of intersection with the Northwesterly lire of
the land described in the Deed dated March 28, 1907 from Martha A. Cornelius,
et vir, to the Southern Pacific Company, recorded March 30, 1907 in Book
1337 of Deeds, Alameda County Records, Page 160, which is the True Point
of Beginning:
THENCE South 34' 23 57" West along said Northwesterly line 60,00 feet to the
Southwesterly line of said Blanding Avenue;
THENCE along last said Southwesterly line of Blanding Avenue North 55' 36' 03"
West 9.45 feet;
THENCE from a tangent bearing North 14° 45' 13" West, along the arc of a 271
foot radius curve to the left, through a central angle of 28' 46' 05,
a distance of 136.07 feet to a point of cusp or the Northeasterly line
of Blanding Avenue;
THENCE along last said line South 559 36' 03" East 129,98 feet to the True
Point of Beginning,
Containing 0.0785 acres more cr less,
BE IT FURTHER RESOLVED that reference is hereby made for particulars of the proposed
vacation to that certain map entitled 'Street Abandonment Blanding Avenue," prepared by Creegan &
D'Angelo, Consulting Engineers, dated November 12, 1973, denominated Drawing 6992, Case 52 in the
City Engineer's records, and on file in the office of the City Clerk,
BE IT FURTHER RESOLVED that the Council of the City of Alameda does hereby find and
determine that the public convenience and necessity require the reservation in the City of Alameda,
pursuant to Sections 8330 and 8331 of the Streets and Highways Code of California, of a permanent
easement and right-of-way over and across and under the above described parcel of land, whole and
entire, for the purpose of constructing, operating, maintaining, replacing, renewing and repairing
thereon all public utilities including, but not limited to, storm sewer pipe lines and outfalls
and facilities for transmission of water and electricity. Said easement and right-of-way shall
provide to the City of Alameda all rights to enter upon the easement for the purposes as set cut
above. Said easement shall vest the control of all imorovements thereon with the City Engineer
of the City of Alameda, and it shall he necessary for the owners of the land through which the
easement exists to procure from the office of the City Engineer a permit or permits for any and all
improvements to be constructed on the surface of the ground.
BE IT FURTHER RESOLVED that there is hereby reserved to the Southern Pacific Company
for railroad purposes, an easement and right-of-way over and across and under the above described
parcel of land, whole and entire,
BE IT FURTHER RESOLVED that these proceedings are taken subject to the reservations
hereinabove set forth,
BE IT FURTHER RESOLVED that all proceedings for the vacation herein proposed shall be in
accordance with the provisions of Part 3 of Division 9, of 05 the Streets and Highways Code of
California,
BE IT FURTHER RESOLVED that notice is hereby given that the 7th day of October, 1975, at 7:30
p.m., in the Council Chamber, located in the City Hall, Santa Clara Avenue and Oak Street, Alameda,
California, is hereby fixed as the time and place for hearing all persons interested in or objecting
to the herein proposed vacation.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause notices of the
street vacation herein proposed tc be posted conspicuously along the line of said street, at least
ten (10) days before the date set for said bearing. Such notices shall be posted not more than 300
feet apart, but at least three (3) shall he posted, and such notices shall state the passage of this
resolution of intention and the time and place of the hereinahove mentioned hearing.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this
resolution published in the manner prescribed by Section 3-14 of the Charter of the City
of Alameda for the publishing of ordinances.
