CITY OF ALAMEDA RESOLUTION NO. 8514
FINDING AND DETERMINING A PORTION OF MARKET STREET NORTHEASTERLY
OF MADISON STREET, A PUBLIC STREET IN THE CITY OF ALAMEDA, IS
UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES; ORDERING
VACATION THEREOF SUBJECT TO RESERVATION OF PERMANENT EASEMENT
THEREIN AS DESCRIBED IN RESOLUTION CF INTENTION NO. 8506
HERETOFORE ADOPTED ON APRIL 6, 1976; AND DIRECTING CITY CLERK TO
CAUSE CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED
WHEREAS, the Council of the City of Alameda did, on the 6th day of April, 1976, adopts its
Resolution of Intention No, 8506 declaring its intention tc order the vacation of an unused portion
of Market Street, a public street in the City of Alameda, said portion being a 20 x 75' strip along
the east side of Market Street northerly of Madison Street, situated in the City of Alameda, County
of Alameda, State of Califcrnia, and more particularly described es follows:
A portion of the northeastern terminus of Market Street, as shown on the
"Map of Alameda", surveyed and drawn by J. T, Stratton, 1853: filed July 24, 1879
in Book 6 of Maps, page 1, in the Office of the Alameda County Recorder, and more
particularly described as follows:
BEGINNING et the point of intersection of the northeastern line of Madison Street
with the southeastern line cf Market Street, said point being the most
western corner of Lot 7, Block 68 as shown on said map;
THENCE northwesterly along said northeastern line of Madison Street 20 feet;
THENCE northeasterly at right angles to last said line, parallel with said
southeastern line of Market Street 75 feet;
THENCE northeasterly at right angles to last said line 20 feet to a point on
the southeastern lire of said Market Street;
THENCE southwesterly along said line of Market Street 75 feet more or less to the

subject, however, to the reservation urto the owner of the property cf 1228 Market Street, located
at the most eastern corner of the northeastern terminus of said Market Street, pursuant to the
provisions of Sections 8330 and 8331 of the Streets and Highways Code of California, of the following
described permanent stcrm drain easement:
A strip of land 5 feet in width being northwesterly of, adjacent to, and
parallel with the southeastern line of Market Street, and extending from the northeastern
line of Madison Street tc a line 75 feet northeasterly therefrom.
WHEREAS, particulars of the proposed vacation are shown on that certain map entitled,
"Partial Abandonment Market Street Northeasterly of Madison St.', prepared by the City Engineer,
dated March, 1976, denominated Drawing 7277, Case 52 in his records, and on file in the office of
the City Clerk; and
WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be
duly published and notice thereof and of the time and place of hearing thereon was duly posted in
accordance with the requirements of Part 3 of Division 9, of the Streets and Highways Code of
California; and
WHEREAS, proof of said publication is evidenced by an affidavit of publication now on
file in the office of the City Clerk of said City; and
WHEREAS, proof of said posting of such notices is evidenced by the affidavit of the
person posting said notices, and is now on file in the office of the City Clerk of said City; and
WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council
of the City of Alameda at this, its regular meeting, on the 4th day of May, 1976, and at the time
and place fixed in said Resolution of Intention, and at such hearing the said Council heard the
evidence offered by all persons interested in said street vacation; and a full hearing thereon
having been had and the matter submitted for determination,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council
hereby finds and determines, from all the evidence submitted, that the certain unused portion of
said Market Street in said Resolution of Intention and hereinbefore more particularly described is
unnecessary for present and prospective public street purposes and that oublic interest requires
the vacation of said street.
BE IT FURTHER RESOLVED that the street in said Resolution of Intention and herinbefore
mare particularly described be, and the same is hereby vacated, subject, however, to the reserva-
tion in the owner cf the property of 1228 Market Street of the storm drain easement hereinabove set
forth.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have a certified copy
of this Resolution recorded in the office of the Recorder of Alameda County, California.
