CITY OF ALAMEDA RESOLUTION NO. 8542
AMENDING RESOLUTION NO. 851.4 FINDING AND DETERMINING A PORTION OF
MARKET STREET NORTHEASTERLY OF MADISON STREET, A PUBLIC STREET IN THE
CITY OF ALAMEDA, IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET
PURPOSES; ORDERING VACATION THEREOF SUBJECT TO RESERVATION OF PERMANENT
EASEMENT THEREIN AS DESCRIBED IN RESOLUTUION OF INTENTION NO, 8506
HERETOFORE ADOPTED ON APRIL 6, 1976; AND DIRECTING CITY CLERK TO
CAUSE CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED
WHEREAS, the Council of the City cf Alameda did, an the 6th day of April, 1976, adopt its
Resolution of Intention No, 8506 declaring its intention to order the vacation of an unused portion
of Market Street, a public street in the City of Alameda, said portion being a 20 x 75' strip along
the east side of Market Street northerly of Madison Street, situated in the City of Alameda, County
of Alameda, State of California, and more particularly described as follows:
A portion of the northeastern terminus of Market Street, as shown on the
'Map of Alameda", surveyed and drawn by J,T. Stratton, 1853; filed July 24, 1879
in Book 6 of Maps, page 1, in the Office of the Alameda County Recorder, and more -
particularly described as follows;
BEGINNING at the point of intersection of the northeastern line of Madison Street
with the southeastern line of Market Street with the southeastern line
of Market Street, said point being the most western corner of Lot 7,
Block 68, as shown on said map;
THENCE northwesterly along said northeastern line of Madison Street, 20 feet;
THENCE northeasterly at right angles to last said line, parallel with said south-
eastern line of Market Street, 75 feet;
THENCE southeasterly at right angles tc last said line, 20 feet to a point on the
southeastern line of said Market Street;
THENCE southwesterly along said line of Market Street, 75 feet, more or less, to the

subject, however, to the reservation unto the owner of the property of 1228 Market Street, located
at the most eastern corner of the northeastern terminus of said Market Street, pursuart to the
provisions of Sections 8330 and 8331 of the Streets and Highways Code of California, of the following
described permanent storm drain easement;
A strip of land, 5 feet in width, the center line of which lies parallel with
and 6 feet northwesterly fror the aforesaid southeastern line of Market Street and
extending:from the aforesaid northeastern line of Madison Street to a line parallel
with and 75 feet northeasterly therefrom,
WHEREAS, particulars of the proposed vacation are shown on that certain map entitled
"Partial Abandonment Market Street Northeasterly of Madison Street,", peepared by the City Engineer,
dated March, 1876, denominated Drawing 7277, Case 52 in his records, and on file in the office of the
City Clerk; and
WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be
duly published and notice thereof and of the time and place of hearing thereon was duly posted in
accordance with the requirements of Part 3 of Division 9, of the Streets and Highways Code of California;
and
WHEREAS, proof of said publication is evidenced by an affidavit of publication now on file
in the office of the City Clerk of said City; and
WHEREAS, proof of -aid posting of such notices is evidenced by the affidavit cf the person
posting said notices, and is now on file in the office of the City Clerk of said City; and
WHEREAS, the matter of said proposed vacation came on regularly for hearing before the
Council „of the City of Alameda, at this, its regular meeting, on the 4th day of May, 1976, and at the
time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the
evidence offered by all persons interested in said street vacation; and a full hearing thereon having
been had and the matter submitted for determination;
NOW. THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby
finds and determines, from all the evidence submitted, that the certain unused portion of said Market
Street in said Resolution of Intention and hereinbefore more particularly described is unnecessary
for present and prospective public street purposes and that public interest requires the vacation of
said street.
BE IT FURTHER RESOLVED that the street in said Resolution of Intention and hereinbefore more
particularly described he, and the same is hereby vacated, subject, however, to the reservation in the
owner of the property of 1228 Market Street of the storm draine easement herinabcve set forth,

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
15th day of June, 1976, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Hurwitp, Sherratt and President Corica, (5).
NOES! None.
ABSENT: None.
