Resolution 08588200 CITY OF ALAMEDA RESOLUTION NO. 8588 AMENDING THE COMPREHENSIVE GENERAL PLAN OF THE CITY OF ALAMEDA BY ADOPTING THE NOISE ELEMENT THEREOF AND CERTIFYING THE ENVIRONMENTAL IMPACT REPORT FOR SAID ELEMENT WHEREAS, by its Ordinance No. 1586, New Series, enacted April 8, 1969, the City adopted as its comprehensive, long-tern general plan for the physical development of the City, that certain document consisting of text, diagrams, maps and other materials, entitled, 'Comprehensive General Plan - 1990 for Alameda, California,' all in accordance with Sections 65300 and following, Government Code of California; and WHEREAS, by state mandate found in Section 65302 (g) of said Code, the City is required to adopt a noise element, to be developed pursuant to regulations established under Section 39850.1 of the Health and Safety Code of the State of California, which quantifies the community noise environment in terms of noise exposure contours for both near and long-term levels of growth and traffic activity, such noise exposure information becoming a guideline for use in development of the land use element to achieve noise compatible land use and also to provide baseline levels and noise source identification for local noise ordinance enforcement, said element being defined and described as the Noise Element of the said General Plan; and WHEREAS, there has been prepared such a document, entitled "Proposed Noise Element- City of Alameda-May, 1976," the same having been submitted to and considered by the Planning Board, which duly noticed and held public hearings thereon, and which, on August 30, 1976, approved said Element, including the Errata Sheet dated August 23, 1976 and certain amendments, and recommended adoption thereof by the City; and WHEREAS, the Council, on September 21, 1976, received said Board's report and recommendations, held a public hearing on the questions of whether said Element conforms to general law and whether its adoption would he in the public interest, heard testimony and took other evidence thereon, following which said Council considered the matter and was fully advised in the premises, and WHEREAS, the Planning Board and the City Council have reviewed and considered the Environmental Assessment on pages 94-96 of the Proposed Noise Element; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the City's said comprehensive General Plan be and hereby is amended by adopting as its Noise Element as a guideline for use in development of the land use element and to provide baseline levels and noise source identification for noise ordinance enforcement, that document hereinabove referred to entitled, "Proposed Noise Element-City of Alameda-May, 1976," as amended, and as heretofore filed in the Office of the City Clerk, BE IT FURTHER RESOLVED that said Council certifies that it has reviewed and considered the information contained in the Environmental Assessment on pages 94-96 of the Proposed Noise Element and further certifies said Assessment, as the Final Environmental Impact Report for the Noise Element of the General Plan, has been completed in compliance with California Environmental Quality Act and state guidelines, * * * * * * * * * * 2 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted hy the Council of the City of Alameda in regular meeting assembled on the 21st day of September, 1976, by the following vote, to wit: AYES: Councilmen Beckam, Diament, Hurwitz, Sherratt and President Corica, (5).
