ADOPTING STATEMENT OF OVERRIDING CONSIDERATIONS IN APPROVING
APPLICATION R-76-5
WHEREAS, Application R-76-5 is one integrated phase of the entire Harbor Bay Isle
Project for which an UP was duly compiled and certified; and
WHEREAS, the EIR on the Harbor Bay Isle Project identifies certain unavoidable
adverse environmental impacts which may occur if the project is approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council
hereby identifies and adopts as a Statement of Overriding Considerations pursuant to Section
15088 of the State fIR Guidelines, the following economic, social and mitigating considerations
which are present and which warrant approval of the Project as in the public interest:
1. Rezoning R-76-5 is necessary to provide needed commercial facilities
for existing and proposed residents of Bay Farm Island,
2. The commercial development of R-76-5 areas will provide additional
sales and property tax revenues for the City.
3. Commercial development in R-76-5 areas is consistent with airport
activities and the City's noise element.

introduced and adopted by the Council of the City of Alameda in regular meeting assembled on
