Resolution 08641CITY OF ALAMEDA RESOLUTION NO. 8641 PROPOSING AMENDMENTS TO THE CHARTER OF THE CITY OF ALAMEDA ON MOTION OF THE CITY COUNCIL; CALLING A SPECIAL MUNICIPAL CHARTER AMENDMENT ELECTION IN THE CITY OF ALAMEDA FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS THEREOF PROPOSALS TO AMEND SAID CHARTER, VIZ: BY AMENDING SECTION 2 -4 TO PROVIDE EACH COUNCILMAN SHALL RECEIVE 650 FOR EACH MEETING AND SHALL NOT RECEIVE SUCH FEES FOR MORE THAN TWO MEETINGS IN ANY ONE CALENDAR MONTH; BY AMENDING SECTION 2 -14 TO PROVIDE A TWO CONSECUTIVE TERM LIMIT FOR APPOINTED OFFICIALS; BY AMENDING SECTIONS 10 -2, AND 10 -4.1 TO ESTABLISH FOUR YEAR TERMS FOR MEMBERS OF THE CIVIL SERVICE BOARD, LIBRARY BOARD AND CITY PLANNING BOARD AND BY AMENDING SECTIONS 10 -1, 10 -4 AND 15 -1 RELATING TO MEMBERSHIP, TERMS AND POWERS AND DUTIES OF THE SOCIAL SERVICE HUMAN RELATIONS BOARD; FIXING THE DATE OF SAID ELECTION, THE MANNER OF HOLDING THE SAME, AND PROVIDING FOR NOTICE THEREOF; AND CONSOLIDATING SAID SPECIAL MUNICIPAL CHARTER AMENDMENT ELECTION WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON MARCH 8, 1977 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA as follows: SECTION 1. The Council of the City of Alameda hereby proposes on its own motion to amend the Charter of the City of Alameda by amending Sections 2 -4, 2 -14, 10 -1, 10 -2, 10 -4.1 and 15 -1 thereof, to read as set forth in the notice entitled, "Proposed Amendments to the Charter of the City of Alameda. SECTION 2. The Council of the City of Alameda , hereby proposes to and does hereby on its own motion submit to the qualified electors of the City of Alameda, at the Special Municipal Charter Amendment Election hereinafter provided for, proposals to amend the Charter of the City of Alameda set forth in said notice hereinafter set forth in Section 3 of this resolution and designates and refers to said proposals as the proposals to be set forth in the form of ballot hereinafter prescribed for use at said Special Municipal Charter Amendment Election. SECTION 3. The City Clerk of the City of Alameda is hereby ordered and directed to cause said proposed amendments to be Charter of the City of Alameda to be published once, not less than forty (40) and not more than sixty (60) days prior to the date of the Special Municipal Charter Amendment Election hereinafter provided for, in the ALAMEDA TIMES -STAR, the official newspaper of said City, and in each edition thereof during the day of publication, said newspaper being a newspaper of general circulation published at least six days a week in said City of Alameda; and such publication may be substantially the following form: PROPOSED AMENDMENTS to THE CHARTER of the CITY OF ALAMEDA Special Municipal Charter Amendment Election March 8, 1977 (Consolidated with General Municipal Election) The Council of the City of Alameda hereby proposes on its own motion to amend the Charter of the City cf Alameda: A -1. By amending Section 2 -14 to read: Sec. 2 -14. No person shall be eligible for the office held by that person for two complete consecutive terms immediately prior to the term for which the person Seeks election or appointment. This section shall not apply to the office of Auditor or Treasurer or prevent persons in office from completing their terms. (Effect: Would add "or appointment to this section which limits appointed as well as elected officials to two consecutive full terms but permits them to be appointed to other offices or after sitting out one term.) 3 -2. By amending Section 10 -2 to read: Sec. 10 -2. Each of said Boards, except the Public Utilities Board, Social Service Human Relations Board and the City Planning Board, shall concist of five members. Upon nomination of the Mayor, the Council shall appoint, between May 1 and July 1 of each year, one member of each such Board for a term commencing on the first day of July following such appointment and continuing for four years, and thereafter until the successor of such member is appointed and qualified. (Effect: Would change from "five years" to "four years" the term of members of the Civil Service Board and Library Board and makes this Section consistent with Section 11 -2 pertaining to the term of members of the Board of Education.) 1 -3. By amending Section 10 -4.1 to read: Sec. 10 -4.1. The City Planning Board shall consist of seven members. Upon nomination of the Mayor, the Council shall appoint, between May 1 and July 1 of each year, such members as are necessary to maintain a full Board, for terms commencing on the first day of July following such appointment and continuing for four years and thereafter until the successor of such member is appointed and qualified; provided, however, that no more than two terms shall expire in any year other than by resignation of a member. (Effect: Would change from "three years" to "four years" the term of members of the City Planning Board and would change the phrase that at such time as this amendment becomes fully operative seven members shall be appointed, two of whom shall be appointed for a period of two years, and three of whom shall be appointed for a period of three years, the duration of said appointments to commence on July 1 next succeeding the operative date of this amendment; all succeeding apointments -shall be for a period of three years." to read that no more than two terms shall expire in any year other than by resignation of a member." C -4. By amending Section 10 -1 to read: Sec. 10 -1. The following Boards are hereby established: Board of Education; Public Utilities Board; Civil Service Board; City Planning Board, Social Service Human Relations Board; Library Board. (Effect: Would change "Social Service Board" to read Social Service Human Relations Board." C -5. By amending Section 10 -4 to read: Sec. 10-4. The Social Service Human Relations Board shall consist of nine members. Upon nomination of the Mayor, the Council shall appoint, between May 1 and July 1 of each year, at least two members of such Board for terms commencing on the first day of July following such appointment and continuing for four years and thereafter until a successor of such member is appointed and qualified. (Effect: Would change the first sentence "The Social Service Board shall consist of seven members, one of whom shall be the City Manager, who shall have full power of participating and voting. to read The Social Service Human Relations Board shall consist of nine members." Would change from "Three years" to "four years" the term of members of the Social Service Human Relations Board. C -6. By amending Section 15 -1 to read: Sec. 15 -1. The Social Service Human Relations Board shall have the power: (A) To encourage the formation of private social welfare organizations to meet needs not already provided for and to foster allworthy philanthropic enterprises. (B) Such other duties and powers as may be delegated by ordinance. (Effect: Would delete present subsections (A), (B), (0) and (D) and replace them with the above language. D -7. By amending Section 2 -4 to read: Sec. 2 -4. The salary attached to the following offices shall be fixed by the Council at not less than the following amounts per annum: Auditor, $3,600.00; Treasurer: $3,600.00; City Manager, $4,000.00; City Attorney, $3; 000.00;.City Clerk, $2,400.00. Each Councilman shall receive $50.00 for each meeting of the Council which he shall' attend; provided, that no Councilman shall receive such fees for more than two meetings in any one calendar month. (Effect: Would change 120.00" to read "$50.00." Otherwise unchanged. The Council of the City of Alameda hereby proposes to and does hereby on its own motion submit to the qualified electors of said City at a Special Municipal Charter Amendment Election to be held in said City on Tuesday, March 8, 1977 (which said election will be consolidated with the General Municipal Election to be held on March 8, 1977), the following proposals to amend said Charter, in the manner hereinabove specifically set forth, as follows: AMENDMENTS TO THE CHARTER OF THE CITY OF ALAMEDA MEASURE A Shall the Charter of the City of Alameda be amended to limit the number of consecutive terms an appointed official may serve to two terms? Said amendment will be accomplished by amending Section 2 -14 of said Charter, all as fully set forth in Resolution No. 8641 of the Council of the City of Alameda. YES NO MEASURE B Shall the Charter of the City of Alameda be amended In provide that all Charter Boards shall have four year terms? Said amendment will be accomplished by amending Sections 10 -2 and 10 -4.1 of said Charter, all as fully set forth in Resolution No. 8641 of the Council of the City of Alameda. MEASURE C Shall the Charter of the City of Alameda be amended to provide that the name of the Social Service Board be changed to Social Service Human Relations Board, that said Board shall consist of nine members, each of said members to serve a four year term, and to have such powers and duties as the City Council shall specify by ordinance? Said amendment will be accomplished by amending Section 10 -1, 10 -4 and 15 -1 of said Charter, all as fully set forth in Resolution No. 8641 of the Council of the City of Alameda. MEASURE D Shall the Charter of the City of Alameda be ameded to provide that each Councilman shall receive $50.00 for each meeting of the Council which he shall attend; provided, that no Councilman shall receive such fees for more than two meetings in any one calendar month? Said amendment will he accomplished by amending Section 2 -4 of said Charter, all as fully set forth in Resolution No. 8641 of the Council of the City of Alameda. (a) A Special Municipal Charter Amendment Election is hereby called to be held in the City of Alameda on Tuesday, March 8,1977 for the purpose of submitting to the qualified electors of said City said proposals set forth in Section 3 of this resolution to amend the Charter of said City as in said proposals in this resolution provided and as hereby submitted by the Council of the City of Alameda on its own motion. (b) Said Special Municipal Charter Amendment Election hereby called shall be held and conducted, and the votes thereat canvassed and the returns thereof made, and the results thereof as certained and determined as herein provided, and in all particulars not prescribed in this resolution, said Special Municipal Charter Amendment Election shall be held as provided for in the Charter of said City and in all particulars not provided for therein said election shall be held as provided for by law for the holding of Special Municipal Elections in the City of Alameda, and otherwise in accordance with the Elections Code of the State of California. (c) All persons qualified to vote at municipal elections in said City of Alameda on the day of the election herein provided for shall be qualified to vote upon said amendments hereby proposed by the Council of the City of Alameda on its own motion and submitted at said Special Municipal Charter Amendment Election. (d) The polls at the polling places hereinafter designated for said Special Municipal Charter Amendment Election shall be opened at 7:00 a.m. of said day of election, and shall be kept open continuously thereafter until 8:00 p.m. of said day of election when the polls shall be closed (except as provided in Section 14436 of the Elections Code), and the election officers shall thereupon proceed to canvass the ballots cast thereat. (e) Said Special Municipal Charter Amendment Election shall be and is hereby consolidated with the General Municipal Election to be held in said City of Alameda on the date of said Special Municipal Charter Amendment Election hereby called, and the election precincts, polling places and voting booths shall in every case be the same, and there shall be only one set of election officers in each of said precincts; and the precincts, polling places and officers of election for said Special Municipal Charter Amendment Election shall be the same as those to be selected and designated by the Council of said City for said General Municipal Election in said City of Alameda by its resolutions,to which resolution reference is hereby made for a designation of the precincts, polling places and election officers for the Special Municipal Charter Amendment Election hereby called. (f) Only one form of ballot shall be used at said General Municipal Election and said Special Municipal Charter Amendment Election hereby consolidated therewith, which, in addition to all other matters required by law to be printed thereon, shall state the measures set forth in Section 3 thereof. (g) Each voter may vote on any one or more of the proposed Charter amendments. To vote in favor of a proposal to amend the Charter of the City of Alameda a voter shall so indicate in the blank space opposite the word "YES" on the ballot to the right of the proposal, and to vote against said proposal a voter shall so indicate in the blank space opposite the word "N0" on the ballot to the right of said proposal. The votes cast for and against the proposed charter amend- ment shall be counted separate and apart from all other measures to be submitted at the Special Municipal Charter Amendment Election hereby called for the purpose of submitting said charter amendments, and if a majority of the qualified voters voting on a proposed charter amendment vote in favor thereof, such charter amendment shall be deemed ratified. (h) The returns of said election shall be rode out and aigned by the election officers and shall by them be deposited with the City Clerk, together with the ballots cast at said election; and this Council shall meet at the usual meeting place and canvass said returns on Tuesday, the 15th day of March, 1977, at the hour of 7:30 p.m. and declare the result of said election. SECTION 5. Said proposed amendments set forth in Section 3 hereof shall be set forth in the election proclamation and notice of the General Municipal Election and Special Municipal Charter Amendment Election to be held on Tuesday, March 8, 1977, to be published in the time and form reuqired by Section 22835 of the Elections Code of the State of California. SECTION 6. The City Clerk of the City of Alameda is hereby authorized and directed (1) to cause copies of the text of said proposed charter amendments to be printed in convenient pamphlet form and in type of not less than eight -point and to cause copies thereof to be mailed to each of the qualified electors of said City, and (2) until the day fixed for said Special Municipal Charter Amendment Election to advertise daily in the ALAMEDA TIMES -STAR, a newspaper of general circulation in said City, a notice that copies of said pamphlet may be had on application therefor. Said notice shall be in substantially the following form: NOTICE OF AVAILABILITY OF CHARTER AMENDMENTS NOTICE IS HEREBY GIVEN to the qualified electors of the City of Alameda that pamphlet copies of the amendments, proposed by the City Council or its own motion, to the Charter of the City of Alameda amending Sectbns 2 -4, 2 -14, 10 -1, 10 -2, 10 -4, 10 -4.1 and 15-1, limiting appointed officials to two consecutive full terms; providing for four year terms for members of Charter Boards; providing for certain changes in the membership and powers and duties of the Social Service Human Relations Board and providing that Councilmen shall receive $50.00 for each Council meeting attended, but said fee to be paid for no more than two meetings in any one calendar month, are on file in the office of the City Clerk , City Hall, Alameda, California, and may be had on application therefor.
