Resolution 08767CITY OF ALAMEDA RESOLUTION NO, 8767 APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3645, AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN: APPROVING BONDS AS TO SUFFICIENCY,, AND ACCEPTING CERTAIN EASEMENTS, ACCESS RIGHTS AND PARCELS OF LAND (HARBOR BAY ISLE ASSOCIATES, SUBDIVIDER) WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, there has heretofore been filed with and approved by the Council a Tentative Map of that certain proposed subdivision known as Tract 3645; and WHEREAS, Harbor of Doric Development, Island, Inc., a Nevada presented to the Counc subdivision known as T Bay Isle Associates, a partnership comprised nc.,,a California corporation and Bay Farm corporation, subdivider herein, has for approval a Final Map of that proposed 3645; and WHEREAS, said subdivider has entered into an agreement with the City of Alameda to construct and complete the public improvements in said subdivision and to post with the City Clerk of the City of Alameda a bond to guarantee full and faithful performance of said work, all in accordance with said Article; and WHEREAS, said Final Map delineates thereon certain easements designated "Public Utilities Easement," "Storm Drain Easement," "Sanitary Sewer Easement" and "Power Easement," and parcels of land known as Bridgeway Road, Packet Landing Road, Barley Neck Road, Oyster Pond Road, Stingaree Way, Oyster Shoals Way: Felucca Landing Way, Poacher's Way and'Popperwood Lane, dedicated to the public; certain access rights for the purposes of lagoon maintenance and operations of public safety vehicles and emergency equipment and certain rights of ingress and egress for the purposes of lagoon maintenance, dedicated to the City of Alameda; and certain strips of land designated as Parcels 1 thru 15, granted to the City of Alameda; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3645 be, and hereby is approved BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improvements in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to, respectively, said agreement on behalf of the City of Alameda. BE IT FURTHER RESOLVED that the bond in the total sum of $4,778 :500, guaranteeing full and faithful performance of the subdivider's said public improvements construction contract, is hereby approved as sufficient in amount; BE IT FURTHER RESOLVED that said easements and parcels of land dedicated to the public are hereby accepted, on behalf of the public, for use in conformity with the terms of the offers of dedication; and said access rights and rights of ingress and egress dedicated to the City of Alameda, and said parcels of land granted to the City of Alameda, are hereby accepted I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 2nd day of August, 1977, by the following vote, to wit: AYES: Councilmen Beckam, Diament, Sherra President Corica, (5). t, Tillman and NOES: None.
