REQUESTING CANCELLATION OF COUNTY TAXES ON REAL
PROPERTY ACQUIRED BY THE CITY OF ALAMEDA FOR
MUNICIPAL PURPOSES (2216 LINCOLN AVENUE)
WHEREAS, the real property situated in the City of
Alameda, County of Alameda, State of California, described as
County Account No 71-219-22 and commonly designated as
2216 Lincoln Avenue, Alameda, has been assessed heretofore for
County purposes for the fiscal year 1976-77 and taxes levied
thereon are uncollected and unpaid; and
WHEREAS, said property was acquired by Order for Immediate
Possession, filed June 17, 1976 in the Superior Court of the
State of California, County of Alameda, City of Alameda v. Rose
A. Cleary, et al., Action No 479450-9, and by Final Order of
Condemnation entered August 5, 1977 and recorded August 10, 1977
in the office of the County Recorder of Alameda County on
Reel 4997, Image 232, Recorder's Receipt No 77-159157, and
since June 17, 1976 has been and is now owned by the City of
Alameda for municipal purposes, and because of such public
ownership is not subject to sale for delinquent taxes;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Board of Supervisors of the County of Alameda
be and it is hereby requested to make its order, and to take
such further proceedings as may be necessary, to cause all
uncollected taxes, assessments, penalties or costs charged or
levied for County purposes upon the aforesaid parcel of real
property, to be cancelled; and that a record of such cancellation
be made by the officer or officers having custory of the record
thereof, in accordance with the provisions of Section 4986 of the
Revenue and Taxation Code of the State of California.
BE IT FURTHER RESOLVED that the City Clerk forward two (2)
certified copies of this Resolution forthwith to the Board of
Supervisors of the County of Alameda.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly Introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 18th day of October,
1977, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Sherratt, Tillman and
President Corica, (5).
NOES: None.
ABSENT: None.
