ORDERING VACATION OF ELECTRICAL POWER EASEMENT
(WITHIN TRACT 1866 - PORTION OF SOUTH SHORE CENTER)
WHEREAS, by its Resolution No. 8814, regularly adopted
October 18, 1977, this Council declared its intention to vacate
that certain electrical power easement hereinafter more
particularly described, all in accordance with provisions of
the state Public Easements Vacation Law, and thereafter caused
publication of said Resolution and posting of notices of said
intended vacation as required by said Law, both said Resolution
and notices fixing the time and place for hearing all persons
interested in the vacation as Tuesday, November 15, 1977 at
7:30 o'clock p,m. in the Council Chamber, City Hall, Alameda,
California; and
WHEREAS, at said time and place the matter of the proposed
vacation came on regularly for hearing by this Council at its
regular meeting, and proof of publication of said Resolution and
of posting of said notices in the manner required by law having
been made by the City Clerk, and the Council then having heard
all the evidence, both oral and documentary, proferred by all
persons interested in said matter, and the Council being fully
advised in the premises and the matter thereupon submitted for
determination;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that:
(1) It is hereby found and determined that the electrical
power easement in said Resolution of Intention and hereinafter
particularly described is unnecessary for present or prospective
public use, and the public interest requires vacation of same;
(2) It is hereby ordered that the following electrical
power easement be, and it is, vacated:
Being a ten -foot wide, strip in Tract 1866 and more
particularly described as:
In Portion of South Shore Center, Alameda, California.
Parcel 4 of the easement as granted by South Shore
Center, Inc., to the City of Alameda filed October
21, 1960, in Reel 191, Image 407, Official Records
of the County of Alameda, California, being a
portion of Block 13 of that certain map entitled,
"TRACT 1866, SOUTH SHORE UNIT NO 1, ALAMEDA,
CALIFORNIA filed October 30, 1957, in Book 38 of
Maps, pages 50 thru 54, inclusive, County of Alameda
records.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 15th day of November,
1977, by the following vote, to wit;
AYES: Councilmen Beckam, Diament, Tillman and President Corica, (4).
NOES: None.
ABSENT: Councilman Sherratt, (1).
