NORTHERLY OF MECARTNEY ROAD, A PUBLIC STREET IN THE
CITY OF ALAMEDA, IS UNNECESSARY FOR PRESENT OR
PROSPECTIVE STREET PURPOSES; ORDERING VACATION
THEREOF SUBJECT TO RESERVATION OF A WATER LINE
EASEMENT THEREIN AS DESCRIBED HEREIN AND IN
RESOLUTION bF INTENTION NO 8828 HERETOFORE- A]5OPTED
ON DECEMBER 6; 1977; AND DIRECTING CITY CLERK'TO
CAUSE CERTIFIED COPY OF THIS RESOLUTION TO BE',

WHEREAS, the Council of the City of Alameda d`d, on the
6th day of December, 1977, adopt its Resolution of I tention
No 8828 declaring its intention to order the vacati n of a
portion of County Road northerly of Mecartney Road, public
street in the City of Alameda, said portion being situated in the
City of Alameda, County of Alameda, State of California, more
particularly described in said Resolution of Intention as follows:
COMMENCING at the United States Coast and Geodetic Survey
Monument " MAIT CLUB'', having coordinates Y =455; 68'1.22 feet
and X= 1;497,730.40 feet based on the California',Cpordinate
System, Zone III, as are all bearings and distances in this
description:
THENCE S. 86 °36'06" W. 86.36 feet to a point on the westerly
line of Maitland Drive, as said Drive is shown on that
certain map entitled "PROPERTY OF UTAH CON RUCTION
COMPANY, BAY FARM ISLAND IN THE CITY OF AL EDA,
ALAMEDA COUNTY, CALIFORNIA", filed August '3, 1956, in
Book 40 of Maps at Pages, 53 to 56, inclusive, County
of Alameda Records;
THENCE S. 11 °23'32" W. along said westerly line 848.00 feet
to an angle point;
THENCE continuing along said westerly line S. 0043'32"
W. 44.19 feet to the most northerly corner of that
parcel of land described in City of Alamed Resolution
No 8729 as recorded June 10, 1977 on Ree1I4902 at
Image 699, Ser. No. 77- 114000, County of Alameda
Records;
THENCE along the northeasterly line of said parce
S. 55 °56'33" E. 9.56 feet to the TRUE POIN OF
BEGINNING;
THENCE S. 55 °56'33" E. 14.36 feet;
THENCE southerly on a tangent curve concave south esterly,
having a radius of 20.00 feet, through a c ntral angle
of 56 °40'05" for an are distance of 19.78feet;
THENCE S. 00 °43'32" W. 173.38 feet;
THENCE southerly on a tangent curve concave westerly, having
a radius of 30.00 feet, through a central angle of
32°4810", for an arc distance of 17.18 feet to a
point on a curve concave westerly having a radius
of 20,00 feet, the radial bearing at said point bears
S. 56°2818" E., said point also being on the
westerly line of said parcel;
THENCE northerly along said westerly line on said curve
concave westerly having a radius of 20.00 feet,
through a central angle of 57°2150, for an arc
distance of 20.02 feet to a point of reverse curvature;
THENCE northerly along a curve concave easterly, having a
radius of 95.00 feet, through a central angle of
24°33'40, for an arc distance of 40.72 feet;
THENCE N. 00°4332" E. 138.89 feet;
THENCE northerly along a curve concave westerly, having a
radius of 20.00 feet, through a central angle of
56°40'05", for an arc distance of 19.78 feet to the
TRUE POINT OF BEGINNING, containing 0.0490 acres,
more or less;
subject, however, to the reservation for the benefit of East Bay
Municipal Utilities District, pursuant to the provisions of
Sections 8330 and 8331 of the Streets and Highways Code of
California, of the following described permanent Water Line Ease-
ment:

and X=1,497,730.40 feet based on the California Coordinate
System, Zone TIT, as are all bearings and distances in this
description:

line of Maitland Drive, as said Drive is shown on that
certain map entitled "PROPERTY OF UTAH CONSTRUCTION
COMPANY, BAY FARM ISLAND IN TIE CITY OF ALAMEDA,
ALAMEDA COUNTY, CALIFORNIA", filed August 13, 1956,
in Book 40 of Maps at Pages 53 to 56, inclusive,
County of Alameda Records;
THENCE S. 11°2332" W. along said westerly line 848.00 feet
to an angle point;
THENCE continuing along said westerly line S. 00°4332"
W. 44.19 feet to the most northerly corner of that
parcel of land described in City of Alameda
Resolution No 8729 as recorded June 10, 1977 on
Reel 4902 at Image 699, Ser. No 77-114000, County
of Alameda Records;
THENCE along the northeasterly line of said parcel
S. 55°5633" E. 9.56 feet;
THENCE S. 55°5633" E. 14.36 feet;

THENCE southerly on a tangent curve concave southwesterly,
having a radius of 20.00 feet, through a central
angle of 28°0407", for an arc distance of 9.80 feet
to the TRUE POINT OF BEGINNING;
THENCE southerly on a tangent curve concave southwesterly,
having a radius of 20.00 feet, through a central angle
of 28°3558", for an arc distance of 9.98 feet;
THENCE S. 00°43'32" W. 150.42 feet;
THENCE N. 17°3928" W. 38.03 feet;
THENCE N. 00°4332" E. 34,77 feet;
THENCE N. 06°5032" E. 89.65 feet to the TRUE POINT OF
BEGINNING.
WHEREAS, particulars of the proposed vacation are shown on
that certain map entitled, "County Road Right-of-way Partial
Abandonment", prepared by Jones-Tillson & Associates, Civil
Engineers, dated October 27, 1977, denominated Drawing 7428B,
Case 54 in the records of the City Engineer, and on file in the
office of the City Clerk; and
WHEREAS, the City Clerk of the City of Alameda caused said
Resolution of Intention to be duly published and notice thereof
and of the time and place of hearing thereon was duly posted in
accordance with the requirements of Part 3 of Division 9, of
the Streets and Highways Code of California; and
WHEREAS, proof of said publication is evidenced by the
affidavit of publication now on file in the office of the City
Clerk of said City; and
WHEREAS, proof of said posting of such notices is evidenced
by the affidavit of the person posting said notices, and is now
on file in the office of the City Clerk of said City; and
WHEREAS, the matter of said proposed vacation came on
regularly for hearing before the Council of the City of Alameda
at its regular meeting on the 3rd day of January, 1978, and at
the tirre and place fixed in said Resolution of Intention, and at
such hearing the said Council heard the evidence offered by all
persons interested in said street vacation; and a full hearing
thereon having been had and the matter submitted for determination;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that said Council hereby finds and determines, from
all the evidence submitted, that a portion of said County Road
in said Resolution of Intention and hereinbefore more particularly
described is unnecessary for present and prospective public street
purposes and that public interest requires the vacation of said
street.
BE IT FURTHER RESOLVED that the portion of said street in
said Resolution of Intention and hereinbefore more particularly
described be, and the same is hereby vacated, subject, however,

to the reservation of the Water Line Easement hereinabove set
forth.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to have a certified copy of this Resolution recorded
in the office of the Recorder of Alameda County, California.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 3rd day of January,
1978, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Sherratt, Tillman,
and President Corica, (5).
NOES: None.
ABSENT: None.
