OVERRULING OBJECTIONS TO NOTICE TO CONSTRUCT SIDEWALK,
CURB, GUTTER AND STREET PAVEMENT ALONG THE SOUTH SIDE
OF SAN ANTONIO AVENUE WESTERLY OF NINTH STREET, ALAMEDA
CALIFORNIA, AND AUTHORIZING SUPERINTENDENT OF STREETS
TO CAUSE SAID WORK TO BE PERFORMED
WHEREAS, on August 16, 1977, a petition containing 38
signatures was submitted to the City Council requesting that side-
walk, curb, gutter and pavement be installed along the south side
of San Antonio Avenue westerly of Ninth Street; and
WHEREAS, in accordance with the provisions of Div. 7, Pt. 3,
Ch. 27 of the Streets and Highways Code of California, Sections
5870 and following, on September 6, 1977, on its own motion, this
Council ordered the installation of such improvements and
authorized the Superintendent of Streets to notify the owner of
said property to perform the work; and
WHEREAS, on March 21, 1978, the Superintendent of Streets
duly notified the owner of said property to construct sidewalk,
curb, gutter and street pavement along the south side of San
Antonio Avenue westerly of Ninth Street; and
WHEREAS, said Notice required said owner to complete con-
struction of said work within sixty days thereafter, the work to
consist of (1) approximately 120 lineal feet of Portland Cement
Concrete sidewalk, five feet wide, three inches thick; (2) approxi-
mately 120 lineal feet of Portland Cement Concrete curb, fifteen
inches deep, six inches wide at the top with a battered face;
(3) approximately 120 lineal feet of Portland Cement Concrete gutter,
eighteen inches wide, six inches thick poured monolithically with
the curb; (4) approximately 120 lineal feet of pavement varying in
width as necessary between the outer edge of the new gutter and a
structurally sound edge of the existing pavement. The new pavement
shall consist of a compacted subgrade, eight inches of compacted
aggregate base and two inches of asphalt concrete surface; (5) all
materials, workmanship, locations and elevations to be in accord
with the City of Alameda Standard Plans and Specifications and to
the satisfaction of the City Engineer; (() surveys, plans, inspec-
tion, equipment erd materials necessary to administer the work; and
WHEREAS, said Notice specified TUESDAY, APRIL 4, 1978, at
7:30 p.m., in the City Council Chamber, located in the City Hall,
as the time and place when the CitY Council will hear and pass upon
objections or protests, if any, which may be raised by said property
owner or other interested persons to said work; and
WHEREAS, the hearing of said matter having regularly come
before this Council at the time and place so noticed, and the
Council having heard and passed upon all such objections or protests
and being fully advised in the premises,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that it is hereby found, determined and decided that all
objections or protests to said Notice or to any matters con-
tained therein, are hereby overruled, and the said Superintendent
of Streets be and he hereby is authorized to cause to be performed
the construction of sidewalk, curb, gutter and street pavement
along the south side of San Antonio Avenue westerly of Ninth
Street, as described in said Notice, all in accordance with the
provisions of said Div. 7, Pt. 3, Ch. 27, of said Streets and
Highways Code of California.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in reaular meetinn assembled on the 4th day of April,
1978, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Sherratt, Tillman,
and President Corica, (5).
NOES: None.
ABSENT: None.
