APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT
3883, AUTHORIZING EXECUTION OF AGREEMENT FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, APPROVING
BONDS AS TO SUFFICIENCY, AND ACCEPTING A CERTAIN
PARCEL OF LAND, EASEMENTS AND RIGHTS OF ACCESS
DEDICATED TO THE CITY AND THE PUBLIC (LOUIS KALISKI,
INC. AND AE REALTY PARTNERS, SUBDIVIDERS)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the
Alameda Municipal Code, there has heretofore been filed with and
approved by the Council a Tentative Map of that certain proposed
subdivision known as Tract 3883; and
WHEREAS, Raymond Kaliski, Martell J. Kaliski, Louis
Kaliski, Inc , a California corporation and AE Realty Partners,
a general partnership, subdividers herein, have presented to the
Council for approval a Final Map of that proposed subdivision
known as Tract 3883; and
WHEREAS, said subdivider has entered into an agreement with
the City of Alameda to construct and complete the public improve-
ments in said subdivision and to post with the City Clerk of the
City of Alameda bonds to guarantee full and faithful performance
of said work and a bond to guarantee certain improvements for a
five -year period; all in accordance with said Article; and
WHEREAS, said Final Map delineates thereon - certain ease
ments dedicated to the public and designated "Public Utilities
Easement" and "Storm Drain Easement "; a certain strip of land
designated as "Bicycle Path ", dedicated to the City of Alameda;
and rights of access for operations of public safety vehicles and
emergency equipment dedicated to the City of Alameda;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Final Map of Tract 3883 be, and hereby as
approved.
BE IT FURTHER RESOLVED that the agreement for construction
and completion of the public improvements in said subdivision,
and all its terms and conditions, be and hereby is approved, and
the City Manager and the City Clerk are authorized and directed
to execute and attest to, respectively, said agreement on behalf
of the City of Alameda:
BE IT FURTHER RESOLED that the Faithful Performance and
Payment Bonds, both in the total sum of $849,000.00, guaranteeing
full and faithful performance of the subdividers' said public
iTTlproierentsconstruction contract, and the bond in the total sum
of $17,000.00, guaranteeing replacement' of Turf -Block pavement if
use of said blocks should prove unsatisfactory within five years,
are hereby approved as sufficient in amount
BE IT FURTHER RESOLVED that the Public Utilities- Easement
and the Storm Drain Easement dedicated to the public are hereby
accepted, on behalf of the public, for use in conformity with the
terms of the offers of dedication; and said access rights and said
parcel of land designated "Bicycle Path" dedicated to the City of
Alameda are hereby accepted:
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 2nd day of May,
1978, by the following vote, to wit:
AYES:. Councilmen Beckam, Diament, Sherratt, TilTman,
and President Corica, (5).
NOES: None.
ABSENT: None.
