Resolution 08946 with letters attachedCITY OF ALAMEDA RESOLUTION NO. 8946 AUTHORIZING EXECUTION OF AGREEMENT WITH ALAMEDA MARINA VILLAGE ASSOCIATES FOR CONSTRUCTION OF IMPROVEMENTS WITHIN BETHLEHEM AVENUE AND TYNAN AVENUE, APPROVING BOND AND TERMINATING AND CANCELLING ORIGINAL AGREEMENT AND BOND WHEREAS, on January 2, 1962, Alaska Packers Association, a California corporation, and Pacific Bridge Company, a Delaware corporation, in consideration of the City's acceptance of the dedication of Bethlehem Avenue and Tynan Avenue as public streets, filed a bond with the City and signed an agreement to construct and install certain improvements, contemplated at that time, within the dedicated areas; and WHEREAS, the real property involved was subsequently sold and Alaska Packers Association and. Pacific Bridge Company have no further interest in the property; and WHEREAS, Alameda Marina Village Associates is willing to assume the existing obligation and agrees to maintain the required bond; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that an agreement with Alameda Marina Village Associates for construction of improvements within Bethlehem Avenue and Tynan Avenue be and hereby is approved and the Mayor and. City Clerk are authorized and directed to execute and attest to, respectively, said agreement on behalf of the City of Alameda. BE IT FURTHER RESOLVED that the bond of Alameda Marina Village Associates, in the amount of $2,500.00, guaranteeing faith- - ful performance of the terms and conditions of this agreement, is hereby approved. BE IT FURTHER RESOLVED that the agreement of Alaska Packers Association and. Pacific Bridge Company, dated. January 2, 1962, and Peerless Insurance Company Contract Bond No. 300590 are hereby terminated and cancelled. HANNA CITY ENGINEER SUBJECT: NOTICE DATED MAY 6, 1968 THAT THE PEERLESS INSURANCE C ANY WISHES TO TERMINATE PERFORI CE BOND NO. 300590 DATED JANUARY 2, 1962 WITH ENCINAL TERMINALS AS THE PRINCIPAL IN CONNECTION WITH THE IMPROVE. MENTS TO BE ON TYNAN AND BETHLEHEM AVENUES At the time these streets were accepted by the City for public thoroughfare purposes it was understood that it might be quite a while before the necessary improvements were specified and accomplished by the benefited parties. There- fore an Agreement was entered into between the City of Alameda and both the Alaska Packers Association and Pacific Bridge Company stating that hey would install certain - improvements and to maintain a faithful performance bond to guarantee for an indefinite period the construction of those improvements being the feeling` that future use of the property to the east would dictate the precise improvements required. As of this date there has been very little development on the property to the east and so we don't know exactly which is the best way to accomplish the objectives of the Agreement. Therefore a bond must remain in full force and effect and either the Peerless Insurance Company can supply it or any other suitable company. I would think that the Peerless Insurance Company should be so advised and also Alaska Packers Association and whoever has the original Pacific Bridge Company obligation as spelled out in the Agreement.
