Resolution 08946CITY OF ALAMEDA RESOLUTION NO. 8946
AUTHORIZING EXECUTION OF AGREEMENT WITH ALAMEDA
MARINA VILLAGE ASSOCIATES FOR CONSTRUCTION OF
IMPROVEMENTS WITHIN BETHLEHEM AVENUE AND TYNAN AVENUE,
APPROVING BOND AND TERMINATING AND CANCELLING ORIGINAL
AGREEMENT AND BOND
WHEREAS, on January 2, 1962, Alaska Packers Association, a
California corporation, and Pacific Bridge Company, a Delaware
corporation, in consideration of the City's acceptance of the
dedication of Bethlehem Avenue and Tynan Avenue as public streets,
filed a bond with the City and signed an agreement to construct and
install certain improvements, contemplated at that time, within the
dedicated areas; and
WHEREAS, the real property involved was subsequently sold
and Alaska Packers Association and. Pacific Bridge Company have no
further interest in the property; and
WHEREAS, Alameda Marina Village Associates is willing to
assume the existing obligation and agrees to maintain the required
bond;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that an agreement with Alameda Marina Village Associates
for construction of improvements within Bethlehem Avenue and Tynan
Avenue be and hereby is approved and the Mayor and. City Clerk are
authorized and directed to execute and attest to, respectively,
said agreement on behalf of the City of Alameda.
BE IT FURTHER RESOLVED that the bond of Alameda Marina
Village Associates, in the amount of $2,500.00, guaranteeing faith-
- ful performance of the terms and conditions of this agreement, is
hereby approved.
BE IT FURTHER RESOLVED that the agreement of Alaska Packers
Association and. Pacific Bridge Company, dated. January 2, 1962, and
Peerless Insurance Company Contract Bond No. 300590 are hereby
terminated and cancelled.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled on the 18, day of July
1978, by the following vote, to wit:
AYES: Councilmen Diament, Beckam, Tillman, and President Corica, (4).
NOES: None.
ABSENT: Councilman Sherratt, (1).
IN WITNESS WHEREOF, I have hereunto set my hand and affixed
the official seal of said City this 19th day of July, 1978
