APPROVING FINAL MAP OF SUBDIVISION KNOWN AS TRACT 3865,
AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF
PUBLIC IMPROVEMENTS THEREIN, APPROVING BONDS AS TO
SUFFICIENCY, AND ACCEPTING CERTAIN PUBLIC STREETS AND
EASEMENTS (AE REALTY PARTNERS, SUBDIVIDER)
WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the
Alameda Municipal Code, there has heretofore been filed with and
approved by the Council a Tentative Map of that certain proposed
subdivision known as Tract 3865; and
WHEREAS, AE Realty Partners, a California general partner-
ship, subdivider herein, has presented to the Council for approval
a Final Map of that proposed subdivision known as Tract 3865 which
is a subdivision of Lot 3, Block 11, Tract 1898; said property
being bounded by Otis Drive, Rosewood Way, the Beach and Tennis
Club and Tract 3922; and
WHEREAS, said subdivider has entered into an agreement with
the City of Alameda to construct and complete the public improve -
ments in said subdivision and to post with the City Clerk of the
City of Alameda bonds to guarantee full and faithful performance
of said work, all in accordance with said Article; and
WHEREAS, said Final Map delineates thereon a certain ease-
ment designated "Public Utility Easement (P.U.E.)" and parcels of
land known as Tarryton Isle, Rosewood Way, Country Isle; Amber Isle
and Larchmont Isle dedicated to the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the Final Map of Tract 3865 be, and hereby is,
approved.
BE IT FURTHER RESOLVED that the agreement for construction
and completion of the public improvements in said subdivision,
and all its terms and conditions, be and hereby is approved, and
the City Manager and the City Clerk are authorized and directed
to execute and attest to respectively, said agreement on behalf
of the City of Alameda.
BE IT FURTHER RESOLVED that the bonds in the sums of
$492,476.00; guaranteeing full and faithful performance of he
subdivider's said public improvements construction contract, are
hereby approved as sufficient in amount.
BE IT FURTHER RESOLVED that said easement and parcels o
land dedicated to the public are hereby accepted on behalf of the
public, for use in conformity with the terms of the offers of
dedication.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted by the Council of the
City of Alameda in regular meeting assembled On the 16th day of January,
1979, by the following vote, to wit:
