Resolution 09124CITY OF ALAMEDA RESOLUTION NO, 9124 ADOPTING MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF ALAMEDA AND TEE BUREAU OF ELECTRICITY AND THE ALAMEDA CITY EMPLOYEES ASSOCIATION BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the attached Memorandum of Understanding agreed to between the City's representatives and the Alameda City Employees Associa- tion is hereby adopted, to be effective July 1, 1979. MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding entered into between the CITY OF ALAMEDA and the BUREAU OF ELECTRICITY, hereinafter called the "CITY," and the ALAMEDA CITY EMPLOYEES ASSOCIATION, hereinafter called the "ASSOCIATION,'", represents the results of meeting and conferring in good faith in accordance with Section 3505 of the California Govern- ment Code, and covers those areas of mutual agreement for the period of July 1, 1979 through June 30, 1980. The parties executing this Memorandum are the duly appointed representatives of the Association and the Municipal Employee Relations Officer of the City of Alameda. The adjustments to wages, hours and conditions of employment set forth in this Memorandum have been discussed in good faith between the parties hero+n. The representatives of the Association' agree to its acceptance by its members of all adjustments set forth herein, and along with the Municipal Employee Relations Officer, agree to recommend to the City Council and the Public Utilities Board that all adjust- ments set forth herein be adopted in full by the City Council and the Public Utilities Board in the manner and under the procedure prescribed by law. It is understood by the parties that the adjustments set forth herein represent only recommended changes in existing policies and procedures as stated in various ordinances, resolutions and -memoranda, and are not represented as a complete and comprehensive statement of these policies and procedures. It is also understood that any adjustments which by law require action by the City Council and the puu|io.u+i|i+ias Board shall become effective and in force only if the Council and Board take such action by its affirmative vote. The classifications of employment within the Bureau of Electricity represented by the Association covered by this Memorandum of Understanding are: Accountant, Utility Accountant, Utility Cost Clerk, Intermediate Clerk, Intermediate Typist Clerk, Senior Typist Clerk, Senior Stenographer Clerk, Customer Service Clerk, Meter Book Clerk, Office Services Clerk, Utility Clerk, Utility Collection Computer Operator Computer Operator, Intermediate ,Computer Operator, Junior Field Representative, Senior Gardener Meter Reader - Collector Secretary, Public Utility Intermediate Utility Clerk Delinquent Accounts Clerk Intermediate Meter - Book Clerk Computer Programmer Field Representative The recommendations of the parties to this Memorandum of Un ers ending include: 1. Salary Effective July 1, 1979 there shall be ng*nera} salary increase for all employees in classifications represented by the of eight percent (8%)' ,2' One-Time Health & Welfare P^yment. Effective July 1, 1979 the City |omod to a one-time payment of Two Hundred Fifty Dollars ($250.00) to each employee, in the service of the City of Alameda on July l' 1979, as + for Health and Welfare insurance costs incurred by the employee in the preceding year and in exchange, the Association agrees to dismiss their .appeal of the Superior Court judgment in Case No. 510397-7. 3. Sewer Maintenance Worker Effective July 1, 1979 the Cify shall establish the classification of Sewer Maintenance Worker and shall compensate +he`Sewcr Maintenance Worker classification at the same rate of pay as the classification of Concrete Worker. 4. Study of Public Works Classifications The City agrees to conduct a classification study of the Public Works classifi- cations, provided, however, that the City is able to obtain Federal funds to conduct such v study. 5. Comprehensive Memorandum of Understanding The City agrees to compile a comprehensive Memorandum of Understanding by April 1, 1980. 6. Acting Pay Effective July 1, 1979 the City agrees to reinstate the City's Acting Pay Policy for the employees in classifications represented by the Association. Section 2-547 of the Alameda Municipal Code shall not be applicable to the classifi- cations represented by the Association but instead these classifications shall be covered by Item 7 (Funeral Leave) and Item 8 (Illness in the Immediate Family) of this Memorandum of Understanding. 7, Funeral Leave In the event of a death in the immediate family of an employee who has one (1) or more years of uninterrupted service with +he C|+ employee :shall, upon request, be granted such time off with pay as is .necessary to make arrangements for the funeral and attend same, not to exceed three (3) regularly scheduled work\ng days. This provision does not apply if the death occurs during the employee's paid vacation, or while the employee is on leave of absence, layoff, or sick leave. For the purposes of this provision, the immediate family shall be restricted to to father, mother, brother, sister, spouse, child, mother-in-law, father-in-law, grandparents and grandchildren. At the request of the Ci+y'|foe ^employee will furnish a death certificate and proof of relationship. Funeral leave applies v"ly,n instanoes'i6whicx the employee attends the funeral. or is required to make funeral arrangements, but is not applicable for other purpose, such as settling the estate of the deceased. 8. Illness in the Immediate ram/|v An employee may use up to twenty (20) hours of accrued sick leave in any twelve (12) consecutive month period for illness in the immedio+o|fomi|y. For the purpose of this provision, immediate family means spouse, child or dependent living within the employee's household. ' At the City's request the employee will provide satisfactory evidence of the facts justifying such absence. 9. Floating xu|iday in LTeu of Cv|vmbus'Qov Effective July 1, 1979 a floating holiday shall be substituted for Columbus Day. The date on which the floating holiday may be celebrated by the employee shall be by mutual agreement between the employee and his or her Department Head or designated representative. 10. Dental Care Effective July 1, 1979 the City sxu||'mon+r/uu+e'7vvv|y-fwo Dollars and Forty-one Cents (522-41) per month per eligible employee toward the City's dental p|an' 11. Kaiser Health Insurance Plan Effective July 1, 1979 the City shall make the following contributions per Month per eligible employee toward the Kaiser Health Insurance Plan: Employee $30.90 Employee and one dependent $67.e0 Employee and two or more dependents $e9.28 Effective November 1, 1979 the contribution shall be increased to the following rate: Employee Employee and one dependent Employee and two or more dependents 131.91 $63.82 192.17 12. Blue Cross Insurance Plan Effective July 1, 1979.lhe City shall make the following contribution per month per eligible employee toward the Blue Cross Health Insurance Plan: Employee Employee and,one dependent Employee and two or more dependents $44.03 1105.95 $131.32 13. Health & Welfare Study The City intends to evaluate the hospital-medical, life insurance, and dental plans which are currently available to employees. In the event that it may be possible to provide hospital-medical life insurance and dental coverage as nearly comparable as possible to the benefits in effect on July 1, 1979, without additional cost to the City or the employees, the City may substitute new insurance carriers. The Association wil f be given an opportunity to review the coverage afforded under such substitute plans before they are implemented. 14. Term of Agreement This Memorandum of Understanding shalt be effective upon ratification by the Association and approval by -the Alameda City CounciLand Public Utilities Board, for the period July 1, 1979 through June 30, 1980, but An no event shall it become effective on a date earlier than July 1, 1979. This Memorandum of Understanding is subject to all existing State laws and the City Charter, ordinances, resolutions and administrative rules of the City except as expressly provided to the contrary by this Memorandum of Understanding. The City of Alameda agrees to continue with any and all benefits and conditions of employment contained in this and prior Memoranda of Understanding with the Association except as specifically superseded by subsequent agreement with the Association.
