A RESOLUTION ESTABLISHING RULES FOR THE APPLICATION
OF CITY EMPLOYEE COMPENSATION RATES AND SCHEDULES,
RELATED REQUIREMENTS, AND NUMBER OF POSITIONS
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that:
Section 1. The rules set forth in this resolution con-
stitute special provisions applicable to all classes of employ-
ment, provided, however, that if any provision of a Memorandum
of Understanding, consummated and approved bythe Council
pursuant to City of Alameda Resolution No. 7476, in effect is
clearly and specifically in conflict with any rule contained in
this resolution, the provision in such Memorandum of Under-
standing shall prevail.
Section 2. Salary Step Plan. The step plan of each
salary range shall be applied and interpreted as follows for
permanent and probationary employees:
A. The first step shall be the minimum rate and shall
normally be the hiring rate for the class. In a case where it
is difficult to secure a qualified person or if a person of
unusual qualifications is engaged, the City Manager, after
receiving the recommendation of the appropriate Department Head,
and the advice of the Director of Personnel, may approve
appointment above the first step.
B. The second step shall be paid upon satisfactory
completion of six months of paid status at the first step.
C. The third step shall be paid upon satisfactory
completion of one year of paid status at the second step.
D. The fourth step shall be paid upon satisfactory
completion of one year of paid status at the third step.
E. The fifth step shall be paid upon satisfactory
completion of one year of paid status at the fourth step.
F. Raises to the second, third, fourth and fifth steps
shall be automatic unless an unsatisfactory service rating
report is made by the appointing authority. Following an un-
satisfactory service rating report, a raise may be delayed by
the department head for not more than six months with the
approval of the City Manager. A raise to any step may be made
at any time by the City Manager on the recommendation of a
department head whenever an employee exhibits unusual merit.
In the case of permanent part -time employees in positions
whose full -time equivalents normally work a 40 hour week,
1,040 hours of service shall equal six months and 2,080 hours
of service shall equal one year of service. In the case of
permanent part -time employees whose full -time equivalents
normally work a 371/2 hour week, 975 hours of service shall equal
six months and 1,950 hours of service shall equal one year of
service.
G. An employee who is promoted from one class to
another having a higher salary range shall have his salary
adjusted to the lowest step in the salary range of the new class
which is at least 5% higher than the rate received in the
employee's former classification. An employee who is paid an
hourly rate determined by resolution who is promoted to a class
having a salary range shall have his salary adjusted in
accordance with the foregoing provisions to the nearest step
in the new class range after adding 5% to the employee's average
monthly earnings. Average monthly earnings are to be computed
by multiplying the hourly rate by 2,080 for 40 hour equivalents
and 1,950 for 371/2 hour equivalents and dividing by twelve.
H. When a class is assigned a new salary range, the
salary of an employee in such class shall be adjusted to the
same relative step in the new salary range, and such adjustment
shall not alter the employee's anniversary date.
I. A permanent employee, filling a position in a higher
class on a temporary basis and who is entitled to the rate of
pay for such higher class, shall be paid in the same manner as
provided for promotion in subsection "G" above.
J. Step increases shall become effective on the first
day of the pay period following the date of completion of re-
quired service, provided that, if such date is the first day of
the pay period, the adjustment shall be effective on such first
day. For purposes of this section, any employee who is absent
without pay shall have his time in service adjusted for a period
equal to the amount of time absent on leave without pay.
Section 3. Rates of compensation provided for by a reso-
lution establishing or approving such compensation are fixed on
the basis of dollars per month for full -time service in full -
time positions unless otherwise clearly indicated.
Section 4. Duty Hours
A. Police Department. The duty week for all sworn and
non-sworn uniformed personnel shall be 40 hours. The duty week
for general clerical personnel shall be 371/2 hours.
B. Fire Department. The duty week for all sworn
uniformed members whose normal tour of duty is for 24 consecu-
tive hours shall average 56 hours per week, as shall be
scheduled by the Chief of the Department. The duty week for
sworn members on regular assignment to the Fire Prevention
Bureau shall be 5 consecutive days of 8 hours each, or 40 hours
per week. In case such a member is serving in an acting
capacity for a member in a higher rank whose duty week is 56
hours, and such member is qualifying for or eligible to receive
acting pay, as provided for elsewhere, such member shall not be
entitled to overtime in addition to acting pay for hours in
excess of 40, except under circumstances where overtime pro-
visions would apply to the member whose place is being taken.
The duty week for non-sworn uniformed personnel shall be 40
hours. For general clerical personnel it shall be 371/2 hours.
C. Library, Public Works, Recreation, Park and Golf
Department. The normal duty week for full-time employees in
the Public Works, Recreation, Park and Golf Departments and for
part-time employees in the Library shall be, or shall be computed
at an hourly rate on the basis of 40 hours, except as provided
under (D) below.
D. City Hall, Administrative, Library and Related. The
duty week for personnel, except as provided under (A) and (C)
above, whose normal base of operations is the City Hall or the
Library, shall be 371/2 hours, except where the nature of the
duties is such that a 40 hour duty week is required because of
the interrelationships with other City Departments or personnel
where the duty week is 40 hours. This determination shall be
made by the City Manager upon the recommendation of the Depart-
ment Head involved. In no case is it intended that any employee,
regardless of Department or location, whose duty week is
currently 371/2 hours, shall have it extended beyond this figure.
Section 5. Overtime Pay
A. Police Department
1. For sworn personnel at or below the rank of
Police Sergeant, or a Police Aide, time and one-half shall
be paid for all overtime worked subsequent to July 1, 1973,
which exceeds an accumulation for each member of 40 hours.
For each employee who has already accumulated more than
40 hours of overtime prior to July 1, 1973, he shall be
compensated only for overtime in excess of his current
overtime accumulation. With the approval of the Chief of
Police, a sworn member may choose compensatory time off,
at time and one-half, in lieu of overtime pay.
2. Except as otherwise provided by Section 2, sub-
paragraph C of Resolution 6232, and in accordance with
existing agreements, a sworn member at or below the rank
of Police Sergeant, or a Police Aide, who is called upon
to perform work on a regular day off, or on a regular
work day, but not contiguous with their regular shift,
shall be guaranteed a minimum of four hours at the rate
of time and one-half to their credit.
3. When a sworn officer at or below the rank of
Sergeant, or a Police Aide, is required by the Department
or by State law to attend a training class on his regular
day off, or on his regular duty day but not contiguous
with his regular shift, he shall be guaranteed a minimum
of two hours overtime at time and one-half which shall
be paid or taken as time off in accordance with existing
policy and regulations.
When a sworn officer at or below the rank of Sergeant,
or a Police Aide, is required by the Department or by
State law to attend a training class contiguous with his
regular duty shift, he shall be guaranteed a minimum of
one hour overtime at time and one-half, with the under-
standing that there may be at the Department's discre-
tion, a break of less than 15 minutes between the
beginning or end of the duty shift and the beginning or
end of the one-hour training period. Such overtime shall
be paid or taken as time off in accordance with existing
policy and regulations.
B. Fire Department
1. For sworn personnel at or below the rank of Fire
Captain, time and one-half shall be paid for all overtime
worked subsequent to July 1, 1972.
2. Required attendance at educational or training
courses during a member's off-duty period shall be com-
pensated for as overtime. A member who becomes eligible
for overtime under this section shall not in addition
be eligible for benefits under the Educational Advance-
ment Program for required in-service training courses.
3. Except as otherwise provided by Section 2, sub-
paragraph C of Resolution 6232, a sworn member at or
below the rank of Fire Captain who is required to be on
duty on his regular day off, or on a regular duty day
contiguous with his regular duty shift, shall be
guaranteed a minimum of two hours overtime to his credit,
with the provision that less than 15 minutes overtime at
the beginning or end of the duty shift shall not be
credited as overtime for the purposes of pay or time off.
C. Other Departments
Except as otherwise provided by Section 2, subpara-
graph C of Resolution 6232, each full -time employee below
the position of Division Head, not included in sub-
paragraphs A and B above, who is required to work on
his regular day off, or on a regular work day, but not
contiguous with his regular shift, shall be guaranteed
a minimum of two hours overtime for such work at time
and one -half.
Section 6. Standby Pay
For sworn Police Department employees at or below the
rank of Police Sergeant, such personnel shall be credited with
one -half of the employee's regular hourly salary rate while on
emergency on -call status, that is, a non -duty status where an
employee is required to be available and on call, and may
actually be called to duty by the Police Department during an
emergency or an anticipated emergency. Any monies received by
employees from the implementation of this policy shall not be
considered pay, salary, or compensation for the purpose of
calculating present or future pension benefits.
Section 7. Call Back Pay
Employees who are called back to work at a time not con-
tiguous with their regular work schedule shall receive a
minimum of two hours overtime for such work at time and one-
half.
Section 8. Uniform Allowance /Equipment Allowance
A. Police Department. All sworn members of the Police
Department shall receive a sum of money in the amount of $300.00
annually as uniform allowance. Non -sworn personnel employed in
the Police Department who are required to wear a distinctive
uniform shall receive a sum of money in the amount of $210.00
annually as allowance therefor.
B. Fire Department. All uniformed members of the Fire
Department shall receive a sum of money in the amount of $300.00
annually as uniform allowance. Said allowance to members of the
Fire Department shall be in lieu, and take the place of, the
uniform damage replacement program heretofore in effect in said
Department, except as to necessary non-uniform items damaged in
the direct performance of duty.
The allowance provided for under 8-A and 8-B shall be
paid quarterly.
C. Crossing Guards. All regularly scheduled Crossing
Guards with more than six months continuous City employment shall
receive a one-time single payment of $46.00 as cost of a uniform.
Replacement of worn or damaged uniforms of such Guards shall be
at City cost upon the written authorization of the Chief of
Police.
D. Other Departments. Full-time employees of all
Departments except those enumerated in paragraphs A and B above,
shall be eligible for special protective clothing at City cost
upon the written authorization of the affected Department Head
and approval of the City Manager. "Special protective clothing"
shall be only those garments or clothing articles necessary to
protect the usual work clothing which the employee normally
wears to and on the job, from unusual hazards or from unusual
wear and tear.
E. Equipment Allowance. Each new probationary Police
Officer employed subsequent to July 1, 1974, shall receive upon
original employment, a one-time equipment allowance in the
amount of $200.00 to apply toward the purchase of non-uniform
items of equipment.
Section 9. Educational Incentive Program
A. Each sworn member of the Police Department at or
below the rank of Police Captain who qualifies for a Training
Incentive Award in accordance with the administrative directive
entitled, "Regulations Governing Police Department Training
Incentive Program," shall receive, so long as such qualifica-
tions are retained, an award in the amount of $90 per month.
B. Each sworn member of the Fire Department, at or below
the rank of Assistant Fire Chief, who qualifies for a Training
Incentive Award in accordance with the administrative directive
entitled, "Regulations Governing Fire Department Education
Advancement Program," shall receive, so long as such qualifica-
tions are retained, an award in the amount of $50.00, $60.00,
$70.00 or $90.00 per month, as determined by and in accordance
with the qualification requirements of the program.
Section 10, Part-Time Employment
Those employees appointed in accordance with Section 7,
Rule V, of the Civil Service Rules shall be paid for actual
hours worked at an hourly rate equivalent to the monthly salary
for Step 1, Step 2 or Step 3 of the class, provided that prior
approval has been obtained in accordance with Section 2A above
for appointment above the first step or at the hourly rate
established for the classification.
Section 11. Vacation Pay Off
Terminating employees with more than one year's service
shall receive, besides the previously earned vacation, the
proportional share of vacation that would otherwise be lost
when an employee terminates after the anniversary date used for
computing vacation benefits.
Section 12. Holiday Pay
A. Police Department. Holiday pay shall be authorized
for all classifications of badge personnel below the level of
Chief of Police. The pay is computed on the basis of 1/21.67
of the individual's monthly salary.
B. Fire Department. Holiday pay shall be authorized
for all classifications of badge personnel below the level of
Fire Chief in both fire prevention and fire supression. The
pay is computed on the basis of 1/21.67 of the individual's
monthly salary.
C. In the event a holiday(s) falls within the vacation
period of an employee, the Department Head shall determine
whether the employee affected shall be paid additional compensa-
tion for such holiday or holidays, at the rate in these
paragraphs provided, or be allowed additional vacation time to
compensate for the loss of such holiday or holidays.
Section 13, Hourly Rate Equivalents
The hourly rate equivalents for monthly salaries shall
be as indicated in Attachment A to this resolution for employees
on either a 371/2 hour work week or a 40 hour work week.
Section 14. Applicable Benefits
All benefits provided by Memorandum of Understanding
to the members of the Management and. Confidential Employees
Association shall also apply to the City Officials not other-
wise covered by an agreement who are paid a monthly salary
rate.

Those regular full -time civil service employees in the classification on Asst. Civil

In addition to normal compensation, positions in classifications at the rank of Fire
Captain or Fire Lieutenant on regular assignment to the Fire Prevention Bureau shall
receive a salary differential of one full step (5%) per month while so assigned.
Positions at the rank of Firefighter shall recieve a salary differential of 6%
while on such assignment.
