Resolution 09223CITY OF ALAMEDA RESOLUTION NO. 9223 STATING AND REQUESTING CONSOLIDATION OF A SPECIAL MUNICIPAL ELECTION TO BE HELD TUESDAY, JUNE 3, 1980, WITH THE STATE OF CALIFORNIA PRIMARY ELECTION TO BE HELD TUESDAY, JUNE 3, 1980 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that t; pursuant to the provisions of Chapter 4, Part 2, Division 12, of ;i the Elections Code of California, and of Section 23302 thereof, ( and pursuant to Article XIX of the Charter of the City of Alameda,; ii a Special Municipal Election for the purpose of submitting to the 0 qualified voters of the City an advisory measure and two Charter amendment measures as set forth in the statements of the questions below, be consolidated with the State of California Primary ( H Election to be held on Tuesday, June 3, 1980. ; 1! BE IT FURTHER RESOLVED that the election precincts, polling tiplaces, voting booths, and election officers who shall conduct , 11 said Special Municipal Election are hereby designated to be the same as the election precincts, polling places, voting booths, V ; 0 and election officers as shall be designated, established o 1; appointed by resolution or ordinance of the Board of Supervisors of the County of Alameda for the purpose of holding and conducting li said Primary Election within the territory affected by this order of consolidation, and that said election shall be held in all ii respects as if there were only one election. t I BE IT FURTHER RESOLVED that the Board of Supervisors of said County of Alameda is hereby authorized and empowered to i It canvass the returns of said Special Municipal Election and certify I; the results thereof. V ; BE IT FURTHER RESOLVED that the Board of Supervisors of -the County of Alameda, be, and it is hereby requested to make its ; order and to take such other and further proceedings as may be necessary to effect the consolidation of said Special Municipal tElection with said State of California Primary Election, all in ;I accordance with the laws of the State of California regulating ; ; 0 and providing for the consolidation of elections, ji i; BE IT FURTHER RESOLVED that the exact form of the measures to be voted on at said Primary Election, and as the same are to o ; H.ppear on the ballot, is as follows: i q t, ADVISORY MEASURE tt IlShall the Governor and Legislature of the State of California be advised that it is the will and desire of the people 4of the City of Alameda that the Governor 4 and Legislature adopt legislation to tt t;apportion the existing six and one-half tcents per dollar of sales and use tax Hso that two cents rather than the It opresent one cent be allocated to cities, l!counties and special districts for a qpriority local services rather than be ;i NO retained by the state for state expenditures or reserves? It is the express intent that this apportionment will have no effect on any spending limitation applicable to the 0 City by virtue of either state or local k} legislation. Further, it is the will of the $people of the City of Alameda that the Governor ka and Legislature enact such an allocation into law no later than July 1,'1980, to avoid o enactment of the proposal through the initia- ive process to cure legislative default. CHARTER AMENDMENT MEASURE A Shall the Charter of the City of Alameda be amended to provide for the abolition of the I elective offices of Auditor and Treasurer and establishment of the office of Finance Director to be appointed by the City Manager, subject to approval by the City Council, said officer to perform the 'duties designated in said Charter and by ordinance for those offices to be abolished? Said amendment will be accomplished by amending Sections 2 -1 and 2 -2 of and adding Section 2 -15 to Article 11, by repealing Article IV in its entirety, by repealing Article V in its entirety on the third Tuesday of the month following the next general municipal election or upon resignation or retirement of the incumbent Treasurer., and by adding Sections 17 -14, 17 -15 and 17 -16 to Article XVII, all as fully set forth in Resolution No. 9223 of the Council of the City of Alameda. CHARTER AMENDMENT MEASURE B Shall the Charter of the City of Alameda be amended to permit consolidation of the City's General Municipal Elections with an election of another government agency? Said amendment will be accomplished by amending Section 19 -2 of Article XIX of said Charter, all as fully set forth in Resolution No. 9223 of the Council of the City of Alameda. BE IT FURTHER RESOLVED that the measures hereinabove re- ferred to shall be designated on the ballot as "Advisory Measure" and "Proposed Amendments to the Charter of the City of Alameda, California," respectively. BE IT FURTHER RESOLVED that the City Clerk of the City of Alameda is hereby directed to immediately file with the Board of Supervisors, County of Alameda, State of California, this Reso- lution, duly certified by said City Clerk, and file a copy of said certified Resolution with the County Clerk of the County of Alameda, State of California.
