ADOPTING A CITY OF ALAMEDA POLICY PROHIBITING SEXUAL
HARASSMENT WITHIN CI'T'Y GOVERNMENT
WHEREAS, the U.S. Equal Employment Opportunity Commission
and the California Fair Employment and Housing Commission have
recently adopted regulations making sexual Yiirassment an unlawful
employment practice; and
WHEREAS, an employer should take all steps necessary to
xual harassment; and
maintain a working environment
WHEREAS, the City is desirous of eliminating its liability
any unlawful actions or its employees; and
WHEREAS, a policy statement has been developed opposing
sexual harassment by any employee of the City of Alameda;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF ALAMEDA that the "City of Alameda Policy Prohibiting Sexual
Harassment," attached hereto as Exhibit "A" is hereby adopted.

POLICY PRDMIBlTlNG SEXUAL HARASSMENT
Sexual harassment is an unlawful employment practice prohibited by State
and Federal ldN, It debilitates morale and interferes in the work productivity of
its victims and their co-workers. All employees must be allowed to work in an
environment free from unsolicited and unwelcome sexual overtures.
Sexual harassment is deliberate or repeated unsolicited verbal comments,
gestures-or physical contact of a sexual nature which are unwelcome. •
Within the City government, o supervisorial employee who uses implicit or
explicit coercive sexual behavior to control, influence, or affect the career,
salary, or job of an employee is engaging in sexual harassment. Similarly, an
employee of the City who behaves in this manner in the process of conducting City
business is engag/ny in sexual harassment. Any employee who participates in
deliberate or repeated unsolicited verbal comments, gestures, or physical contact
a sexual nature which are unwelcome is also engaging in sexual harassment.
It is the policy of the City of Alameda that sexual harassment is unacceptable
employee conduct and will not be condoned or tolerated. City officials and
employees who violate this policy may be subject to firm disciplinary action up to
and including dismissal. An individual grieving sexual haruSSmeDt should first
discuss the concern with management of the department. If a satisfactory solution
is not accomplished through informal means, the individual may pursue the concern
with the Senior Personnel Analyst in the Personnel Department' The individual may
also pursue the concern through the grievance pr0cedUre,
Prevention is the best tool for the elimination of sexual harassment. All
City departments shall take the initiative to inform all employees of the policy
statement and of the sanctions. They shall also inform all employees of how a
complaint of sexual harassment should be handled. They shall express strong
disapproval of sexual harassment and develop methods to improve awareness of all
concerned.
However, it is not the intent of the City of Alameda to regulate the social
,interaction cr relationships freely entered into by City employees.
