Resolution 09525CITY OF ALAMEDA RESOLUTION NO. 9525 ORDERING VACATION OF CERTAIN PUBLIC UTILITY EASEMENT WITHIN TRACT 4254, CENTRE COURT, HARBOR BAY ISLE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the certain Public Utility Easement located within Tract 4254, recorded in the County Recorder's Office on March 12, 1980, in Book 117 of Maps, at pages 39 and 40, and described as: An easterly portion of that certain parcel of land designated, "P.U.0. and E..8.M.0.D. "° upon that certain map entitled, "TRACT 4254' filed March 12, 1980, in Book 117 of Maps, at Pages 39 and 40, Alameda County Records, and more particularly described as follows: BEGINNING at the point of intersection of the northern line of that certain strip of land designated, "12' Emergency' Access Easement, :.0.M.U.D. & P.11E." and the eastern line of that parcel of land designated, "P-U.E. & EaB.M.U.D." upon said Map of Tract 4254, said Point of Beginning being distant N. 76 °28'27_" E., 282.06 feet fro the City of Alameda Survey Monument having coordinates Y= 458,446.26 feet and X- 1,497,835.71 feet, based on California Coordinate System,` Zone 3, as are all bearings and distances in this :description, as said monument is shown upon said map of Tract 4254; thence along the westerly prolongation of last said northern line, S. 79 °10'17" W., 30.50 feet; thence N. 10 °49'43" W., 7.26 feet; thence N. 79 °10 °17" E., 30.50 feet; thence S. 10 °49'43 " E., 7.26 feet to the Point of Beginning. is hereby ordered vacated pursuant to the provisions of Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, and particularly Section 8333 thereof: BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (1) the said easement ordered vacated herein is unnecessary for present or prospective public use, and (2) that said easement has never been used by the City of Alameda for any purpose whatever since the date of its acquisition to the date of this resolut.ion.' BE IT FURTHER RESOLVED that the City Clerk shall cause a certified copy of this order, attested under seal, to be recorded in the County Recorder's Office and from and after the date this resolution is recorded the public utility easement' vacated no longer shall constitute a public ufility' easement. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular adjourned meeting assembled on the 28th of April, 1981, by the following vote, to wit: AYES: Councilmen Diament, Sherratt, Stone, Tillman and President Corica - 5.
