A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ALAMEDA OPPOSING
ADOPTION OF SB 1093 AMENDING THE "QUIMBY ACT" TO REQUIRE MANDATORY
DENSITY BONUS FOR PARKLAND DEDICATION
WIlEREAS the City Council of the City of Alameda has adopted a General
Plan which provides for a balance of land use, circulation, and open space;
and
IATEREAS said General Plan relates housing density to open space and
circulation needs and standards; and
WHEREAS land dedication for parks within the City must be in conform-
ance with the General Plan of the City and thus in balance with other develop-
ment criteria; and
WHEREAS the number of dwelling units allowed on a given property is
typically the maximum number of units suitable for the site, dedications for
park and open space uses notwithstanding; and
WHEREAS property owners may now elect to provide in lieu fees in place
of land for open space; and
WHEREAS proximity to open space or parks enhances residential value
and livability; and
WHEREAS, mandatory density increases not related to location of said
units and street capacities, community facilities or other environmental
and development considerations may tax existing facilities and place an unnec-
essary burden on neighboring homes, schools and utilities.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA
that on behalf of the citizens of the City of Alameda, the City Council
opposes approval of the proposed SB 1093 which would amend Section 66477 of
the Government Code and urges defeat of this proposed legislation.
BE IT FURPIER RESOLVED that the City Clerk is authorized and directed
to send a copy of this Resolution to each member of the State Senate and to
the League of California Cities.
