Resolution 09948CITY OF ALAMEDA RESOLUTION NO. 9948 ACCEPTING PROPOSAL AS AGREEMENT (L. S. MASON & ASSOCIATES FOR STRUCTURAL REVIEW AND UNIFORM BUILDING CODE PLAN CHECK OF BUILDINGS IN MARINA VILLAGE PROJECT WHEREAS, five buildings located within the Marina Village Project require substantial structural renovation; and WHEREAS, the structural plan checking for these buildings will be extensive and time consuming and would considerably con- strain the City's Building Inspections Department review at this time; and WHEREAS, L. S. Mason & Associates, Consulting Engineers, has submitted a proposal to provide the structural and U.D.C. progress review and plan check for these five buildings; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the proposal of L. S. Mason & Associates, dated November 22, 1982, a copy of which is attached, for its services for the structural plan check and U.B.C. review of five buildings 'coated in the Marina Village Project, is hereby accepted and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute and accept, and the City Clerk to attest to, said Proposal on behalf of the City; and BE IT FURTHER RESOLVED that the cost, of said services shall be reimbursed to the City in full by Vintage Properties - Alameda Corporation as evidenced by its approval, attached to said proposal as Exhibit A. BE IT FURTHER RESOLVED that said Proposal and this Resolution shall constitute the contract of the parties hereto. L. S. We shall provide the structural and U.B.C. progress review and plan check for this project, but not to include plumbing, mechanical, and electrical review or state energy conservation compliance. The City of Alameda should state which issue of the U.B.C. is to be used for this project. We have structured our proposal in two parts: 1. Periodic design review and consultations: This work will generally consist of meetings with the Architect and/or Engineer as requested by them for review of the design. There also may be some time required to re- view or analyze a design approach as requested by the Architect or Engineer. We propose to do this work on a time and material basis. It is difficult to estimate the amount of involvement we would have in this phase of the work. We suggest that you budget $ 4,000.00 for this work. We have attach- ed our fee schedule, which shall be valid for this project thru December 31, 1983. If the budget figure is being approached, we will notify your office as to that fact. 2. Plan check of the completed design project as noted below. We propose to do this work on a time and material basis. (See attached fee schedule). Mason and Asso- ciates, Consulting Engineers, to provide the structural rev;ew and UBC plan check for several buildings in our Marina Village project. We have reviewed the proposal and accept the scope of work and proposed fees, which we understand are on a time and materials basis up to a maximum guaranteed price. We hereby agree to reimburse the City of Alameda for the fees quoted in Mason's proposal up to the guaranteed maximum price quoted. It is our understanding that their review and plan check will act as the Building Department's review of our construction docuements for the following projects: 1) the Bethlehem Building renovation; 2) Building A renovation; 3) the Power House renovation; and 4) new buildings referred to as Building B and Building E. In the near future we plan to consult with Mason at the schematic level of our building plans in order to get an interpretation that we are complying with the UBC structural interpretation. This will allow us to proceed into design development and working drawings, knowing that we are in compliance with Alameda's interpretation of the code, and thereby minimize the eventuality of having to redesign thc project at the working drawing level.
